Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Return to Work Act’’. 4 SEC. 2. REINSTATE PRIOR REMOTE WORK POLICIES. 5 (a) IN GENERAL.—Not later than 60 days after the 6 date of the enactment of this Act, the head of each execu- 7 tive agency shall reinstate the telework policies in use by 8 such executive agency on December 31, 2019. 9 VerDate Sep 11 2014 03:20 Jan 14, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H101.IH H101 pbinns on DSKJLVW7X2PROD with $$_JOB 2 •HR 101 IH (b) RULE OF CONSTRUCTION.—Beginning on the 1 date on which the head of an executive agency reinstates 2 the telework policies in use by such executive agency on 3 December 31, 2019, the reinstated telework policy of such 4 executive agency shall apply in place of any telework provi- 5 sion of a teleworking, collective bargaining, or other em- 6 ployment agreement of such executive agency to the extent 7 that such telework provision conflicts with, or applies a 8 different telework policy than, the reinstated telework pol- 9 icy of such executive agency. 10 (c) DEFINITIONS.—In this section: 11 (1) EXECUTIVE AGENCY.—The term ‘‘executive 12 agency’’ has the meaning given such term in section 13 105 of title 5, United States Code. 14 (2) REINSTATED TELEWORK POLICY.—The 15 term ‘‘reinstated telework policy’’ means the 16 telework policies in use by an executive agency on 17 December 31, 2019. 18 (3) TELEWORK.—The term ‘‘telework’’ has the 19 meaning given such term in section 6501 of title 5, 20 United States Code. 21 Æ VerDate Sep 11 2014 03:20 Jan 14, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\H101.IH H101 pbinns on DSKJLVW7X2PROD with $$_JOB
