following bill; which was referred to the Committee on Agriculture
A BILL
To amend the Food and Nutrition Act of 2008 to make
permanent the moratorium on SNAP benefit transaction
fees, and other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Ensuring Fee-Free
4
Benefit Transactions Act of 2023’’.
5
SEC. 2. AMENDMENTS.

Section 7 of the Food and Nutrition Act of 2008 (7
7
U.S.C. 2011 et seq.) is amended—
8
(1) in subsection (d) by inserting ‘‘including
9
completeness of fraud protection and prevention

tools and coverage of infrastructure cost’’ before the

period at the end,

(2) in subsection (f)(5)(B)(ii) by inserting ‘‘and
3
require State agencies to review existing technology
4
and contract requirements during each contracting
5
period to ensure the EBT technology reflects com-
6
mercial standards to ensure security of benefits’’ be-
7
fore the period at the end, and
8
(3) in subsection (h)(13)(B)—
9
(A) by striking ‘‘Effective through fiscal
10
year 2023, neither’’ and inserting ‘‘Neither’’,
11
and
12
(B) by inserting ‘‘, for costs to implement
13
subsections (d) and (f)(5)(B) of section 7, or
14
for other costs associated with updating the
15
EBT processing infrastructure’’ before the pe-
16
riod at the end.

SEC. 3. APPLICATION OF AMENDMENTS.

The amendments made by section 2 shall be applied
19
to supersede the provisions of title IV of division HH of
20
the Consolidation Appropriations Act, 2023 or any agency
21
action taken under the authority of such provisions.

SEC. 4. EFFECTIVE DATE.

This Act and the amendments made by this Act shall

take effect October 1, 2023.
