To modernize the Undetectable Firearms Act of 1988.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Undetectable Firearms
4
Modernization Act’’.

SEC.
2.
MODERNIZATION
OF
THE
PROHIBITION
ON
6
UNDETECTABLE FIREARMS.
7
Section 922(p) of title 18, United States Code, is
8
amended—
9
(1) in paragraph (1)—
10
(A) in subparagraph (A), by striking
11
‘‘grips, stocks, and magazines, is not as detect-

able as the Security Exemplar, by walk-through
1
metal detectors calibrated and operated to de-
2
tect the Security Exemplar’’ and inserting ‘‘all
3
parts other than major components, does not
4
contain detectable material’’; and
5
(B) in subparagraph (B), by striking
6
‘‘when subjected to inspection by the types of x-
7
ray machines commonly used at airports, does
8
not generate’’ and inserting the following: ‘‘if
9
subjected to inspection by the types of detection
10
devices commonly used at airports for security
11
screening, would not generate’’;
12
(2) in paragraph (2)—
13
(A) by striking subparagraph (B) and in-
14
serting the following:
15
‘‘(B) the term ‘major component’, with respect
16
to a firearm—
17
‘‘(i) means the slide or cylinder, or the
18
frame or receiver of the firearm; and
19
‘‘(ii) in the case of a rifle or shotgun, in-
20
cludes the barrel of the firearm; and’’; and
21
(B) by striking subparagraph (C) and the
22
proviso that follows and inserting the following:

‘‘(C) the term ‘detectable material’ means mate-
24
rial that produces a magnetic field that is equivalent

in strength to the magnetic field produced by 3.7

ounces of 17–4 PH stainless steel.’’;
2
(3) in paragraph (3)—
3
(A) in the first sentence, by inserting
4
after ‘‘of a firearm’’ the following: ‘‘, in-
5
cluding a prototype,’’; and
6
(B) by striking the second sentence;
7
and
8
(4) in paragraph (5), by striking ‘‘shall not
9
apply to any firearm which’’ and all that follows and
10
inserting the following: ‘‘shall not apply to—
11
‘‘(A) any firearm received by, in the possession
12
of, or under the control of the United States; or
13
‘‘(B) the manufacture, importation, possession,
14
transfer, receipt, shipment, or delivery of a firearm
15
by a licensed manufacturer or licensed importer pur-
16
suant to an existing contract with the United
17
States.’’.
