United States-Russian Federation Seafood Reciprocity Act of 2023

Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘United States-Russian 4 Federation Seafood Reciprocity Act of 2023’’. 5 SEC. 2. FINDINGS. 6 Congress makes the following findings: 7 (1) In 2014, the Russian Federation invaded 8 and annexed the Crimean Peninsula from Ukraine. 9 VerDate Sep 11 2014 22:07 Jun 22, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S2011.IS S2011 kjohnson on DSK79L0C42PROD with BILLS 2 •S 2011 IS (2) The United States and its allies imposed 1 sanctions with respect to the Russian Federation as 2 a result of that hostile and illegal action. 3 (3) In retaliation, the Government of the Rus- 4 sian Federation imposed an embargo on agricultural 5 products, including seafood, imported from the 6 United States, the European Union, Australia, Can- 7 ada, and Norway. 8 (4) Before imposing the embargo, the Russian 9 Federation was an important export market for 10 United States seafood products. 11 (5) Imports into the United States of seafood 12 products of Russian Federation origin increased 13 roughly 173 percent in value between 2013, the year 14 before the imposition of the embargo, and 2020. 15 (6) On March 11, 2022, the President issued 16 Executive Order 14068 (87 Fed. Reg. 14381; relat- 17 ing to prohibiting certain imports, exports, and new 18 investment with respect to continued Russian Fed- 19 eration aggression), which prohibited the importa- 20 tion of seafood of Russian Federation origin. The 21 Office of Foreign Assets Control of the Department 22 of the Treasury allowed imports of banned seafood 23 that had pre-existing written contracts or written 24 agreements until June 23, 2022. 25 VerDate Sep 11 2014 22:07 Jun 22, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S2011.IS S2011 kjohnson on DSK79L0C42PROD with BILLS 3 •S 2011 IS (7) Executive Order 14068 does not prohibit 1 the importation of seafood products of Russian Fed- 2 eration origin that are substantially transformed in 3 another country. 4 (8) Despite the brutal, illegal invasion of 5 Ukraine by the Russian Federation, seafood prod- 6 ucts of Russian Federation origin continue to enter 7 United States commerce. 8 SEC. 3. SENSE OF CONGRESS. 9 It is the sense of Congress that— 10 (1) aggression against Ukraine by the Govern- 11 ment of the Russian Federation must prompt a re- 12 evaluation of United States-Russian Federation 13 trade policies, particularly with respect to categories 14 of goods for which the Government of the Russian 15 Federation has already taken retaliatory action 16 against the United States; and 17 (2) a robust United States seafood industry in 18 which domestic consumers and businesses have ac- 19 cess to and can purchase domestically and 20 sustainably harvested seafood and seafood products 21 supports national security and United States jobs. 22 VerDate Sep 11 2014 22:07 Jun 22, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S2011.IS S2011 kjohnson on DSK79L0C42PROD with BILLS 4 •S 2011 IS SEC. 4. PROHIBITION ON ENTRY OF SEAFOOD AND SEA- 1 FOOD PRODUCTS FROM THE RUSSIAN FED- 2 ERATION. 3 (a) IN GENERAL.—The importation into the United 4 States of any product described in subsection (b) is pro- 5 hibited. 6 (b) PRODUCTS DESCRIBED.—A product described in 7 this subsection is a product— 8 (1) classifiable under chapter 3 or heading 9 1604 of the Harmonized Tariff Schedule of the 10 United States; and 11 (2) of Russian Federation origin, including any 12 such product incorporated into another product or 13 substantially transformed in a country other than 14 the Russian Federation. 15 SEC. 5. TERMINATION. 16 (a) IN GENERAL.—The prohibition under section 4 17 shall terminate on the date that is 90 days after the date 18 on which the President determines and certifies to Con- 19 gress that the Government of the Russian Federation has 20 terminated its prohibition on the importation of seafood 21 products from the United States. 22 (b) NOTIFICATION TO U.S. CUSTOMS AND BORDER 23 PROTECTION.—Upon making the certification described in 24 subsection (a), the President shall notify the Commis- 25 sioner of U.S. Customs and Border Protection with re- 26 VerDate Sep 11 2014 22:07 Jun 22, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S2011.IS S2011 kjohnson on DSK79L0C42PROD with BILLS 5 •S 2011 IS spect to the date on which the prohibition under section 1 4 terminates. 2 SEC. 6.
