Mr. HAWLEY (for himself and Mr. BLUMENTHAL) introduced the following
bill; which was read twice and referred to the Committee on Commerce,
Science, and Transportation
A BILL
To waive immunity under section 230 of the Communications
Act of 1934 for claims and charges related to generative
artificial intelligence.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. NO SECTION 230 IMMUNITY FOR CLAIMS AND
3
CHARGES RELATED TO GENERATIVE ARTIFI-
4
CIAL INTELLIGENCE.

Section 230 of the Communications Act of 1934 (47
6
U.S.C. 230) is amended—
7
(1) in subsection (e), by adding at the end the
8
following:

‘‘(6) NO EFFECT ON CLAIMS RELATED TO GEN-

ERATIVE
ARTIFICIAL
INTELLIGENCE.—Nothing in
2
this section (other than subsection (c)(2)(A)) shall
3
be construed to impair or limit any claim in a civil
4
action or charge in a criminal prosecution brought
5
under Federal or State law against the provider of
6
an interactive computer service if the conduct under-
7
lying the claim or charge involves the use or provi-
8
sion of generative artificial intelligence by the inter-
9
active computer service.’’; and

(2) in subsection (f), by adding at the end the
11
following:

GENERATIVE
ARTIFICIAL
INTEL-
13
LIGENCE.—The term ‘generative artificial intel-
14
ligence’ means an artificial intelligence system that
15
is capable of generating novel text, video, images,
16
audio, and other media based on prompts or other
17
forms of data provided by a person.’’.
