which was referred to the Committee on Ways and Means, and in addi-
tion to the Committee on Oversight and Accountability, for a period to
be subsequently determined by the Speaker, in each case for consider-
ation of such provisions as fall within the jurisdiction of the committee
concerned
A BILL
To strengthen the requirements relating to advance electronic
information for cargo, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Uniform Postal Data
4
Acquisition for Transparency and Early Detection within
5
the United States Postal Service Act’’ or the ‘‘UPDATED
6
USPS Act’’.

(a) ELIMINATION OF RESTRICTION ON USE OF AD-
4
VANCE ELECTRONIC INFORMATION FOR COMMERCIAL EN-
5
FORCEMENT.—Section 343(a)(3)(F) of the Customs Bor-
6
der Security Act of 2002 (19 U.S.C. 1415(a)(3)(F)) is
7
amended by striking ‘‘, and shall’’ and all that follows
8
through ‘‘thereunder’’.
9
(b) ELIMINATION OF WAIVERS OF REQUIREMENT TO
10
TRANSMIT ADVANCE ELECTRONIC INFORMATION
FOR
11
COUNTRIES.—
12
(1) IN GENERAL.—Section 343(a)(3)(K)(vi) of
13
the Customs Border Security Act of 2002 (19
14
U.S.C. 1415(a)(3)(K)(vi)) is amended—
15
(A) by striking subclauses (II), (III), and
16
(IV); and
17
(B) by striking ‘‘(I) Notwithstanding’’ and
18
inserting ‘‘Notwithstanding’’.
19
(2) EFFECTIVE DATE.—The amendments made
20
by paragraph (1) take effect on the date that is 180
21
days after the date of the enactment of this Act.
22
(c) REQUIREMENT TO REFUSE SHIPMENTS
FOR

graphs (1) and (2) is not transmitted as re-

quired under this subparagraph.’’.

(d) INCLUSION OF LETTER CLASS MAIL; PUBLICA-
9
TION OF NUMBER OF SHIPMENTS FOR WHICH ADVANCE
10
ELECTRONIC INFORMATION NOT TRANSMITTED.—Sec-
11
tion 343(a)(3)(K) of the Customs Border Security Act of
12
2002 (19 U.S.C. 1415(a)(3)(K)) is amended—
13
(1) by redesignating clauses (viii) and (ix) as
14
clauses (x) and (xi), respectively; and
15
(2) by inserting after clause (vii) the following:
16
‘‘(viii) Not later than December 31, 2023,
17
the Postal Service shall arrange for the trans-
18
mission to the Commissioner of the information
19
described in paragraphs (1) and (2) for all
20
international mail shipments.
21
‘‘(ix) Not less frequently than every 30
22
days, the Postal Service shall publish on a pub-
23
licly accessible internet website the number of
24
international mail shipments for which the in-
25

(e) MONTHLY REPORT.—Section 343(a) of the Cus-
5
toms Border Security Act of 2002 (19 U.S.C. 1415(a))
6
is amended by adding at the end the following:
7
‘‘(6) MONTHLY
REPORT.—Not later than 90
8
days after the date of the enactment of the UP-
9
DATED USPS Act, and every 30 days thereafter,
10
the Secretary shall publish, for the preceding 30-day
11
period, the following information:
12
‘‘(A) The total volume of international
13
mail shipments and other cargo received by the
14
Postal Service and private sector importers for
15
which advance electronic information is sub-
16
mitted under this section.
17
‘‘(B) The number of packages included in
18
such shipments and cargo that U.S. Customs
19
and Border Protection requested to screen and
20
the number of packages provided for such
21
screening by the Postal Service and private sec-
22
tor importers.
23
‘‘(C) An assessment of the results of in-
24
spections by U.S. Customs and Border Protec-

‘‘(F) The number of international mail

shipments, disaggregated by letters and pack-
14
ages, received from each foreign country.’’.

(f) TECHNICAL AMENDMENTS.—Section 343 of the
16
Customs Border Security Act of 2002 (19 U.S.C. 1415)
17
is amended—
18
(1) in subsection (a)(3)(G), by striking the sec-
19
ond period at the end;
20
(2) by amending subsection (c) to read as fol-
21
lows:
22
‘‘(c) SECRETARY DEFINED.—In this section, the
23
term ‘Secretary’ means the Secretary of the Treasury and
24
the Secretary of Homeland Security acting jointly.’’; and
