A BILL
To amend title XIX of the Social Security Act to ensure
that medical assistance is available to children in foster
care who are placed in a qualified residential treatment
program under the Medicaid program.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Ensuring Medicaid
4
Continuity for Children in Foster Care Act of 2023’’.

SEC. 2. ENSURING THAT MEDICAL ASSISTANCE IS AVAIL-

ABLE TO CHILDREN IN FOSTER CARE WHO

ARE PLACED IN A QUALIFIED RESIDENTIAL

TREATMENT PROGRAM UNDER THE MED-
4
ICAID PROGRAM.

(a) IN GENERAL.—Section 1905(a)(31)(B) of the So-
6
cial Security Act (42 U.S.C. 1396d(a)(31)(B)) is amended
7
by inserting ‘‘and care and services provided to any indi-
8
vidual who is a child in foster care under the responsibility
9
of a State who has been placed, in accordance with the
10
requirements of section 475A(c), in a child care institution
11
that is a qualified residential treatment program (as de-
12
fined in section 472(k)(4)), but only if payments are being
13
made on behalf of such child under section 472 with re-
14
spect to which Federal payments may be made under sec-
15
tion 474(a)(1) and only if the child continues to be in fos-
16
ter care under the responsibility of a State’’ after ‘‘section
17
1915(l)’’.

(b) EFFECTIVE DATE.—The amendment made by
19
subsection (a) shall apply with respect to medical assist-
20
ance furnished in calendar quarters beginning on or after
21
October 1, 2023.
