A BILL
To ensure references to opioid overdose reversal agents in
grant programs of the Department of Health and
Human Services are not limited to naloxone.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Halting the Epidemic
4
of Addiction and Loss Act of 2023’’ or the ‘‘HEAL Act
5
of 2023’’.

SEC. 2. REFERENCES TO OPIOID OVERDOSE REVERSAL
7
AGENTS IN HHS GRANT PROGRAMS.

(a) IN GENERAL.—The Secretary of Health and
9
Human Services shall ensure that, whenever the Depart-

ment of Health and Human Services issues a regulation,
1
guidance, or other document for any grant program ad-
2
dressing opioid misuse and use disorders, any reference
3
to an opioid overdose reversal agent (such as a reference
4
to naloxone) is inclusive of any opioid overdose reversal
5
agent that has been approved or otherwise authorized for
6
use by the Food and Drug Administration.

(b) EXISTING REFERENCES.—

(1) UPDATE.—Not later than the end of cal-
9
endar year 2023, the Secretary of Health and
10
Human Services shall update all references described
11
in paragraph (2) to be inclusive of any opioid over-
12
dose reversal agent that has been approved or other-
13
wise authorized for use by the Food and Drug Ad-
14
ministration.

(2) REFERENCES.—A reference described in
16
this paragraph is any reference to an opioid overdose
17
reversal agent (such as naloxone) in any regulation,
18
guidance, or other document of the Department of
19
Health and Human Services that—
20
(A) was issued before the date of enact-
21
ment of this Act; and
22
(B) is for—
23
(i) the grant program for State and
24
Tribal response to opioid use disorders

Cures Act (42 U.S.C. 290ee–3 note; com-

monly referred to as ‘‘State Opioid Re-

sponse Grants’’ and ‘‘Tribal Opioid Re-

sponse Grants’’); or

(ii) the grant program for priority

substance use disorder prevention needs of
7
regional and national significance under
8
section 516 of the Public Health Service
9
Act (42 U.S.C. 290bb–22).
