SECTION 1. SHORT TITLE.
1
This Act may be cited as the ‘‘Stop Harboring Ira-
2
nian Petroleum Act of 2023’’.
3
SEC. 2. DEFINITIONS.
4
In this Act:
5
(1) ALIEN.—The term ‘‘alien’’ has the meaning
6
given that term in section 101(a) of the Immigration
7
and Nationality Act (8 U.S.C. 1101(a)).

(2)
APPROPRIATE
CONGRESSIONAL
COMMIT-
9
TEES.—The term ‘‘appropriate congressional com-
10
mittees’’ means—
11
(A) the Committee on Foreign Relations
12
and the Committee on Banking, Housing, and
13
Urban Affairs of the Senate; and
14
(B) the Committee on Foreign Affairs and
15
the Committee on Financial Services of the
16
House of Representatives.
17
(3) FAMILY MEMBER.—The term ‘‘family mem-
18
ber’’ means, with respect to an individual, a spouse,
19
child, parent, sibling, grandchild, or grandparent of
20
the individual.
21
(4) FOREIGN PERSON.—The term ‘‘foreign per-
22
son’’ means an individual or entity that is not a
23
United States person.
24
(5) FOREIGN PORT.—The term ‘‘foreign port’’
25
means any harbor, marine terminal, or other shore

side facility outside of the United States used prin-
1
cipally for the movement of goods on the water.
2
(6) KNOWINGLY.—The term ‘‘knowingly’’, with
3
respect to conduct, a circumstance, or a result,
4
means that a person has actual knowledge, or should
5
have known, of the conduct, the circumstance, or the
6
result.
7
(7) MATERIAL SUPPORT.—The term ‘‘material
8
support’’ has the meaning given the term ‘‘material
9
support or resources’’ in section 2339A of title 18,
10
United States Code.

(8)
UNITED
STATES
PERSON.—The
term
12
‘‘United States person’’ means—
13
(A) a United States citizen or an alien law-
14
fully admitted for permanent residence to the
15
United States; or
16
(B) an entity organized under the laws of
17
the United States or any jurisdiction within the
18
United States, including a foreign branch of
19
such an entity.
20
(9) VESSEL.—The term ‘‘vessel’’ means any
21
watercraft or aircraft capable of being used as a
22
means of transportation on, under, or over water.
23
SEC. 3. STATEMENT OF POLICY.

It is the policy of the United States—

(1) to deny the Islamic Republic of Iran the
1
ability to engage in destabilizing activities, support
2
international terrorism, fund the development and
3
acquisition of weapons of mass destruction and the
4
means to deliver such weapons by limiting export of
5
petroleum and petroleum products by the Islamic
6
Republic of Iran;
7
(2) to deny the Islamic Republic of Iran funds
8
to oppress and commit human rights violations
9
against the Iranian people who are assembling
10
peacefully to redress the Iranian regime;
11
(3) to sanction entities that violate the laws of
12
the United States by providing support to the Ira-
13
nian energy sector; and
14
(4) that the actions of the Islamic Republic of
15
Iran to finance and facilitate the participation of
16
foreign terrorist organizations in ongoing conflicts
17
and illicit activities is detrimental to the national se-
18
curity interests of the United States.

SEC. 4. SANCTIONS WITH RESPECT TO FOREIGN PERSONS
20
THAT ENGAGE IN CERTAIN TRANSACTIONS.
21
(a) IMPOSITION OF SANCTIONS.—
22
(1) IN GENERAL.—On and after the date that
23
is 90 days after the date of the enactment of this
24
Act, the President shall impose the sanctions de-

scribed in subsection (b) with respect to a foreign
1
person that the President determines knowingly en-
2
gaged, on or after such date of enactment, in an ac-
3
tivity described in paragraph (2).
4
(2) ACTIVITIES DESCRIBED.—A foreign person
5
engages in an activity described in this paragraph if
6
the foreign person—
7
(A) owns or operates a foreign port that,
8
on or after the date of the enactment of this
9
Act, permitted to dock at such foreign port a
10
vessel—
11
(i) that is included on the list of spe-
12
cially
designated
nationals
and
blocked
13
persons maintained by the Office of For-
14
eign Assets Control of the Department of
15
the
Treasury
for
transporting
Iranian
16
crude oil; or
17
(ii) of which the operator or owner of
18
such vessel otherwise knowingly engages in
19
a significant transaction to transport, off-
20
load, or deal in condensate, refined, or
21
unrefined petroleum products, or other pe-
22
trochemical products originating from the
23
Islamic Republic of Iran;

(B) owns or operates a vessel that con-
1
ducts a sea-to-sea transfer involving a signifi-
2
cant transaction of any petroleum product origi-
3
nating from the Islamic Republic of Iran;
4
(C) owns or operates a refinery that en-
5
gages in a significant transaction to process, re-
6
fine, or otherwise deal in any petroleum product
7
originating from the Islamic Republic of Iran;
8
(D) is a family member of a foreign person
9
described in subparagraph (A), (B), or (C);
10
(E) is owned or controlled by a foreign
11
person described in subparagraph (A), (B), (C),
12
or (D); or
13
(F) engages in a significant transaction
14
with, or provides material support to, a foreign
15
person described in subparagraph (A), (B), (C),
16
(D), or (E).

(b)
SANCTIONS
DESCRIBED.—The
sanctions
de-
18
scribed in this subsection are the following:
19
(1) SANCTIONS ON FOREIGN VESSELS.—Subject
20
to such regulations as the President may prescribe,
21
the President may prohibit a vessel described in sub-
22
section (a)(2)(A) or (a)(2)(B) from landing at any
23
port in the United States—

(A) with respect to a vessel described in
1
subsection (a)(2)(A), for a period of not more
2
than 2 years beginning on the date on which
3
the President imposes sanctions with respect to
4
a related foreign port described in subsection
5
(a)(2)(A); and
6
(B) with respect to a vessel described in
7
subsection (a)(2)(B), for a period of not more
8
than 2 years.
9
(2) PROPERTY BLOCKING.—The President shall
10
exercise all of the powers granted to the President
11
under the International Emergency Economic Pow-
12
ers Act (50 U.S.C. 1701 et seq.) to the extent nec-
13
essary to block and prohibit all transactions in prop-
14
erty and interests in property of the foreign person
15
if such property and interests in property are in the
16
United States, come within the United States, or are
17
or come within the possession or control of a United
18
States person.
19
(3) INELIGIBILITY FOR VISAS, ADMISSION, OR
20
PAROLE.—
21
(A) VISAS,
ADMISSION,
OR
PAROLE.—In
22
the case of an alien, the alien is—
23
(i) inadmissible to the United States;

(ii) ineligible to receive a visa or other
1
documentation to enter the United States;
2
and
3
(iii) otherwise ineligible to be admitted
4
or paroled into the United States or to re-
5
ceive any other benefit under the Immigra-
6
tion and Nationality Act (8 U.S.C. 1101 et
7
seq.).
8
(B) CURRENT VISAS REVOKED.—
9
(i) IN GENERAL.—The visa or other
10
entry documentation of an alien described
11
in subparagraph (A) shall be revoked, re-
12
gardless of when such visa or other entry
13
documentation was issued.
14
(ii) IMMEDIATE
EFFECT.—A revoca-
15
tion under clause (i) shall—
16
(I) take effect immediately;
17
(II)
automatically
cancel
any
18
other valid visa or entry documenta-
19
tion that is in the alien’s possession;
20
and
21
(III) be implemented in accord-
22
ance with section 221(i) of the Immi-
23
gration and Nationality Act (8 U.S.C.
24
1201(i)).

(4) IMPLEMENTATION; PENALTIES.—
1
(A) IMPLEMENTATION.—The President—
2
(i) may exercise all authorities pro-
3
vided under sections 203 and 205 of the
4
International Emergency Economic Powers
5
Act (50 U.S.C. 1702 and 1704) to carry
6
out this section; and
7
(ii) not later than 180 days after the
8
date of the enactment of this Act, shall
9
prescribe such regulations as necessary to
10
carry out this Act.
11
(B)
NOTIFICATION
TO
CONGRESS.—Not
12
later than 10 days before the effective date of
13
any regulation prescribed under subparagraph
14
(A)(ii), the President shall brief the appropriate
15
congressional committees on the proposed regu-
16
lations and the provisions of this Act relating to
17
such regulations.
18
(C) PENALTIES.—A person that violates,
19
attempts to violate, conspires to violate, or
20
causes a violation of this section or any regula-
21
tion, license, or order issued to carry out this
22
section shall be subject to the penalties set
23
forth in subsections (b) and (c) of section 206
24
of the International Emergency Economic Pow-

scribed in subsection (a) of that section.

(c) EXCEPTIONS.—
4
(1) EXCEPTION RELATING TO IMPORTATION OF
5
GOODS.—
6
(A) IN GENERAL.—A requirement to block
7
and prohibit all transactions in all property and
8
interests in property under this section shall not
9
include the authority or a requirement to im-
10
pose sanctions on the importation of goods.
11
(B) GOOD.—In this paragraph, the term
12
‘‘good’’ means any article, natural or manmade
13
substance, material, supply or manufactured
14
product, including inspection and test equip-
15
ment, and excluding technical data.
16
(2) EXCEPTION TO COMPLY WITH UNITED NA-
17
TIONS HEADQUARTERS AGREEMENT AND LAW EN-
18
FORCEMENT
ACTIVITIES.—Sanctions
under
sub-
19
section (b)(3) shall not apply with respect to an
20
alien if admitting or paroling the alien into the
21
United States is necessary to permit the United
22
States to comply with the Agreement regarding the
23
Headquarters of the United Nations, signed at Lake
24
Success June 26, 1947, and entered into force No-

(3)
EXCEPTION
TO
COMPLY
WITH
INTEL-

LIGENCE,
LAW
ENFORCEMENT,
AND
OTHER
NA-

TIONAL
SECURITY
ACTIVITIES.—Sanctions
under
6
subsection (b) shall not apply with respect to a for-
7
eign person if such foreign person is a subject or
8
target of, or otherwise involved in, an intelligence,
9
law enforcement, or national security activity of the
10
United States, as determined by the President.
11
(d) WAIVERS.—
12
(1) IN
GENERAL.—The President may waive
13
the application of sanctions under this section with
14
respect to a foreign person for a period not to exceed
15
180 days if the President—
16
(A) determines that such a waiver is vital
17
to the national interests of the United States;
18
and
19
(B) not less than 15 days before the grant-
20
ing of the waiver, submits to the appropriate
21
congressional committees a notice of and jus-
22
tification for the waiver.
23
(2) SPECIAL RULE.—

(A)
IN
GENERAL.—The
President
may
1
waive the application of sanctions under this
2
section with respect to a foreign person if the
3
President certifies in writing to the appropriate
4
congressional committees that—
5
(i) the foreign person—
6
(I) has ceased engaging in activi-
7
ties described in subsection (b); or
8
(II) has taken and is continuing
9
to take significant verifiable steps to-
10
ward ceasing such activities; and
11
(ii) the President has received reliable
12
assurances from the government of the for-
13
eign country that such foreign person will
14
not resume engaging in any activity de-
15
scribed in subsection (b).
16
(B) SUNSET.—The authority to grant a
17
waiver under this paragraph shall terminate on
18
the date that is 5 years after the date of the
19
enactment of this Act.
20
SEC. 5. REPORT ON PETROLEUM AND PETROLEUM PROD-
21
UCT EXPORTS FROM IRAN.
22
(a) IN GENERAL.—Not later than 120 days after the
23
date of the enactment of this Act, the Administrator of
24
the Energy Information Administration shall submit to
