A BILL
To amend the Nuclear Waste Policy Act of 1982 to prioritize
the acceptance of high-level radioactive waste or spent
nuclear fuel from certain civilian nuclear power reactors,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ββSpent Fuel
4
Prioritization Act of 2023ββ.

SEC. 2. ACCEPTANCE PRIORITY FOR HIGH-LEVEL RADIO-

ACTIVE WASTE AND SPENT NUCLEAR FUEL.

Section 302(a) of the Nuclear Waste Policy Act of
3
1982 (42 U.S.C. 10222(a)) is amended by adding at the
4
end the following:
5
ββ(7) In determining the order in which the Secretary
6
will accept high-level radioactive waste or spent nuclear
7
fuel for disposal or storage, the Secretary shall prioritize
8
high-level radioactive waste or spent nuclear fuel from a
9
civilian nuclear power reactor based on the operating sta-
10
tus of the civilian nuclear power reactor, the population
11
of the area in which the civilian nuclear power reactor is
12
located, the earthquake hazard of the area in which the
13
civilian nuclear power reactor is located, and national se-
14
curity risk related to the continued storage of high-level
15
radioactive waste or spent nuclear fuel in the area in which
16
the civilian nuclear power reactor is located, giving highest
17
priority to a civilian nuclear power reactor that isβ
18
ββ(A) decommissioned or decommissioning;
19
ββ(B) located in an area, as determined by the
20
Secretary, the population of which is the largest;
21
ββ(C) located in an area with the highest hazard
22
of an earthquake, as indicated by the Seismic Haz-
23
ard Maps published by the Director of the United
24
States Geological Survey pursuant to section

ββ(D) located in an area, as determined by the

Secretary (in consultation with the Secretary of De-

fense and the Secretary of Homeland Security),
