Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Banning Unlawful Ma- 4 chinegun Parts Act of 2023’’ or the ‘‘BUMP Act of 5 2023’’. 6 SEC. 2. PROHIBITION. 7 (a) IN GENERAL.—Chapter 44 of title 18, United 8 States Code, is amended— 9 VerDate Sep 11 2014 04:32 Jul 06, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S1909.IS S1909 pbinns on DSKJLVW7X2PROD with $$_JOB 2 •S 1909 IS (1) in section 921(a), by inserting after para- 1 graph (30) the following: 2 ‘‘(31) The term ‘semiautomatic firearm’ means any 3 firearm that— 4 ‘‘(A) uses a portion of the energy of a firing 5 cartridge to extract the fired cartridge case and 6 chamber the next shell or round; 7 ‘‘(B) requires a separate function of the trigger 8 to fire each cartridge; and 9 ‘‘(C) is not a machinegun.’’; 10 (2) in section 922, by inserting after subsection 11 (u) the following: 12 ‘‘(v)(1) Except as provided in paragraphs (3) and (4), 13 on and after the date that is 120 days after the date of 14 enactment of this subsection, it shall be unlawful for any 15 person to import, sell, manufacture, transfer, receive, or 16 possess, in or affecting interstate or foreign commerce— 17 ‘‘(A) any manual, power-driven, or electronic 18 device primarily designed, or redesigned, so that 19 when the device is attached to a semiautomatic fire- 20 arm the device— 21 ‘‘(i) materially increases the rate of fire of 22 the firearm; or 23 ‘‘(ii) approximates the action or rate of fire 24 of a machinegun; 25 VerDate Sep 11 2014 04:32 Jul 06, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1909.IS S1909 pbinns on DSKJLVW7X2PROD with $$_JOB 3 •S 1909 IS ‘‘(B) any device, part, or combination of parts, 1 that is designed and functions to materially increase 2 the rate of fire of the firearm, by eliminating the 3 need for the operator of the firearm to make a sepa- 4 rate movement for each individual function of the 5 trigger; or 6 ‘‘(C) a semiautomatic firearm that has been 7 modified in any way that— 8 ‘‘(i) materially increases the rate of fire of 9 the firearm; or 10 ‘‘(ii) approximates the action or rate of fire 11 of a machinegun. 12 ‘‘(2) Except as provided in paragraph (3), not later 13 than 120 days after the date of enactment of this sub- 14 section, any person who lawfully owns or possesses a semi- 15 automatic firearm that was modified as described in para- 16 graph (1)(C) before such date of enactment shall register 17 the semiautomatic firearm in accordance with section 18 5841 of the Internal Revenue Code of 1986. 19 ‘‘(3) This subsection does not apply with respect to 20 the importation for, manufacture for, sale to, transfer to, 21 or possession by or under the authority of, the United 22 States or any department or agency thereof or a State, 23 or a department, agency, or political subdivision thereof. 24 VerDate Sep 11 2014 04:32 Jul 06, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1909.IS S1909 pbinns on DSKJLVW7X2PROD with $$_JOB 4 •S 1909 IS ‘‘(4) Paragraph (1) shall not apply to any lawful 1 transfer or possession of a semiautomatic firearm de- 2 scribed in paragraph (1)(C) that— 3 ‘‘(A) was lawfully modified and possessed before 4 the date of enactment of this subsection; and 5 ‘‘(B) is registered in accordance with paragraph 6 (2).’’; and 7 (3) in section 924(a)(2), by striking ‘‘, or (o)’’ 8 and inserting ‘‘(o), or (v)’’. 9 (b) AMENDMENT TO THE NATIONAL FIREARMS 10 ACT.—Section 5845(a) of the Internal Revenue Code of 11 1986 is amended by striking ‘‘and (8) a destructive de- 12 vice’’ and inserting ‘‘(8) a destructive device; and (9) a 13 semiautomatic firearm, as defined in section 921 of title 14 18, United States Code, that is modified as described in 15 section 922(v)(1)(C) of such title’’. 16 Æ VerDate Sep 11 2014 04:32 Jul 06, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S1909.IS S1909 pbinns on DSKJLVW7X2PROD with $$_JOB
