A BILL
To amend title 49, United States Code, to restrict an air
carrier from operating certain aircraft in all-cargo air
transportation without meeting certain requirements for
intrusion resistance, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Cargo Flight Deck
4
Security Act of 2023’’.

SEC. 2. IMPROVED ALL-CARGO FLIGHT DECK INTEGRITY

MEASURES.

(a) IN GENERAL.—Chapter 447 of title 49, United
3
States Code, is amended by adding at the end the fol-
4
lowing:
5
‘‘§ 44741. All-cargo flight deck integrity measures
6
‘‘(a) IN GENERAL.—It shall be unlawful for an air
7
carrier to operate a covered aircraft after January 1,
8
2027, in a covered operation unless such aircraft is
9
equipped with a cockpit door that—
10
‘‘(1)
meets
the
requirements
of
section
11
25.795(a) of title 14, Code of Federal Regulations,
12
with respect to intrusion resistance; and
13
‘‘(2) remains locked while the aircraft is in
14
flight, as directed by the pilot in command of such
15
aircraft.

‘‘(b) EFFECT OF RULEMAKING.—The requirement of
17
subsection (a) shall take effect on January 1, 2027, re-
18
gardless of whether the Administrator of the Federal Avia-
19
tion Administration has issued regulations to implement
20
such requirement.

‘‘(c) DEFINITIONS.—In this section:
22
‘‘(1) COVERED AIRCRAFT.—The term ‘covered
23
aircraft’ means an aircraft with a cockpit door under
24
subsection (a)(1) on each new aircraft manufactured
25
after January 1, 2027, for delivery used in all-cargo

air transportation with a maximum certificated pay-

load capacity that exceeds 6,500 pounds.

‘‘(2) COVERED OPERATION.—The term ‘covered
3
operation’ means an operation in all-cargo air trans-
4
portation under the provisions of part 121 of title
5
14, Code of Federal Regulations.’’.

(b) CLERICAL AMENDMENT.—The analysis for chap-
7
ter 447 of title 49, United States Code, is amended by
8
adding at the end the following:

‘‘44741. All-cargo flight deck integrity measures.’’.
