A BILL
To direct the Secretary of Homeland Security to prioritize
the removal of certain aliens, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Prioritizing the Re-
4
moval of Migrants Act’’.
5
SEC. 2. PRIORITIZING REMOVAL OF CERTAIN ALIENS.

In executing faithfully the immigration laws (as such
7
term is defined in section 101 of the Immigration and Na-
8
tionality Act (8 U.S.C. 1101)), the Secretary of Homeland

Security shall prioritize immigration enforcement actions
1
with respect to the following aliens:
2
(1) Aliens who are inadmissible under para-
3
graph (2), (3), or (6)(C) of section 212(a) of the Im-
4
migration and Nationality Act (8 U.S.C. 1182(a)(2),
5
(3), (6)(C)).

(2) Aliens who are subject to expedited removal
7
under section 235 of that Act (8 U.S.C. 1225).
8
(3) Aliens who are deportable under paragraph
9
(2) or (4) of section 237(a) of that Act (8 U.S.C.
10
1227(a)(2), (4)).

(4) Aliens who are otherwise inadmissible under
12
such section 212 or deportable under such section
13
237, and who—
14
(A) have been convicted of any criminal of-
15
fense;
16
(B) have been charged with any criminal
17
offense, which charges are pending;
18
(C) have committed acts that constitute a
19
chargeable criminal offense (except an offense
20
under section 275(a) of the Immigration and
21
Nationality Act (8 U.S.C. 1325(a)));
22
(D) have engaged in fraud or willful mis-
23
representation in connection with any official

matter or application before a governmental
1
agency;
2
(E) have abused any program related to
3
receipt of public benefits;
4
(F) are subject to a final order of removal,
5
but who have not complied with their legal obli-
6
gation to depart the United States; or
7
(G) in the judgment of an immigration of-
8
ficer, otherwise pose a risk to public safety or
9
national security.

(5) Aliens who are threats to border security,
11
including aliens who—
12
(A) are apprehended while attempting to
13
unlawfully enter the United States along a bor-
14
der of the United States (whether or not at a
15
designated port of arrival); or
16
(B) are apprehended in the United States
17
after entering unlawfully after November 1,
18
2020.
