mittee on the Judiciary
A BILL
To amend the Immigration and Nationality Act to limit
the ability to take into account the mental health of
an applicant for asylum.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Asylum Claims Im-
4
provement Act of 2023’’.

SEC. 2. MENTAL HEALTH CONSIDERATION.

(a) ASYLUM.—Section 208(b) of the Immigration and
7
Nationality Act (8 U.S.C. 1158(b)) is amended by adding
8
at the end the following:

‘‘(4) For purposes of the consideration of a

claim of asylum by an alien under this subsection,
2
the mental health of the alien may not be taken into
3
account.’’.
4
(b) WITHHOLDING OF REMOVAL.—Section 241(b)(3)
5
of the Immigration and Nationality Act (8 U.S.C.
6
1231(b)(3)) is amended by adding at the end the fol-
7
lowing:

‘‘(D) For purposes of a determination
9
under this paragraph, the mental health of the
10
alien may not be taken into account.’’.
