Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SETTLEMENT OF CLAIMS. 3 (a) JURISDICTION CONFERRED ON THE UNITED 4 STATES COURT OF FEDERAL CLAIMS.— 5 (1) IN GENERAL.—Notwithstanding any other 6 provision of law, the United States Court of Federal 7 Claims shall have jurisdiction to hear, determine, 8 and render judgment on a land claim of the Miami 9 Tribe of Oklahoma under the Treaty between the 10 VerDate Sep 11 2014 03:44 Jun 16, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S1783.IS S1783 pbinns on DSKJLVW7X2PROD with $$_JOB 2 •S 1783 IS United States of America, and the tribes of Indians 1 called the Delawares, Pottawatimies, Miames, Eel 2 River, and Weas, signed at Grouseland August 21, 3 1805 (7 Stat. 91) (commonly known and referred to 4 in this Act as the ‘‘Treaty of Grouseland’’), without 5 regard to the statute of limitations, including section 6 2501 of title 28, United States Code, and any delay- 7 based defense, including laches, estoppel, or acquies- 8 cence, no matter how characterized. 9 (2) LIABILITY OF THE UNITED STATES.—The 10 United States shall be the only entity or individual 11 liable for a land claim made under paragraph (1). 12 (3) JURISDICTION EXPIRATION.—Not later 13 than 1 year after the date of enactment of this Act, 14 the jurisdiction conferred to the United States Court 15 of Federal Claims under paragraph (1) shall expire 16 unless the Miami Tribe of Oklahoma files a land 17 claim under that paragraph. 18 (b) EXTINGUISHMENT OF TITLE AND CLAIMS.—Ex- 19 cept for a claim filed under subsection (a)(1), all other 20 claims of the Miami Tribe of Oklahoma, or any member, 21 descendant, or predecessor in interest to the Miami Tribe 22 of Oklahoma, to title arising under the Treaty of 23 Grouseland are extinguished. 24 Æ VerDate Sep 11 2014 03:44 Jun 16, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\S1783.IS S1783 pbinns on DSKJLVW7X2PROD with $$_JOB
