SELF-DETERMINATION FOR FOOD SAFETY AND IN- 1 SPECTION SERVICE AUTHORITY. 2 Title I of the Indian Self-Determination and Edu- 3 cation Assistance Act (25 U.S.C. 5321 et seq.) is amended 4 by adding at the end the following: 5 ‘‘SEC. 112. SELF-DETERMINATION FOR FOOD SAFETY AND 6 INSPECTION SERVICE AUTHORITY. 7 ‘‘(a) FOOD SAFETY AND INSPECTION SERVICE SELF- 8 DETERMINATION AUTHORIZED.—The Secretary of Agri- 9 culture shall enter into self-determination contracts, in ac- 10 cordance with subsection (c), with Tribal organizations, on 11 the request of any Indian Tribe, by Tribal resolution, sub- 12 ject to subsection (b), to carry out the authority of the 13 Food Safety and Inspection Service under the Federal 14 Meat Inspection Act (21 U.S.C. 601 et seq.) and the Agri- 15 cultural Marketing Act of 1946 (7 U.S.C. 1621 et seq.). 16 ‘‘(b) FOOD SAFETY AND INSPECTION SERVICE CON- 17 TRACTS.— 18 ‘‘(1) IN GENERAL.—A Tribal organization seek- 19 ing to enter into a self-determination contract de- 20 scribed in subsection (a) shall, before requesting to 21 enter into that contract, adopt, by Tribal resolution, 22 a food and agriculture code approved by the Sec- 23 retary of Agriculture, after which the Secretary of 24 Agriculture shall exercise the authority of the Sec- 25 retary of Agriculture under Public Law 87–718 (7 26 VerDate Sep 11 2014 03:58 Jun 16, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1780.IS S1780 pbinns on DSKJLVW7X2PROD with $$_JOB 3 •S 1780 IS U.S.C. 1633) with respect to the Indian Tribe gov- 1 erned by that Tribal organization. 2 ‘‘(2) RURAL WATER, WASTE DISPOSAL, AND 3 COMMUNITY FACILITIES LOANS AND GRANTS.—An 4 Indian Tribe operating under a contract described in 5 subsection (a) shall be eligible for grant and loan 6 programs under section 306(a) of the Consolidated 7 Farm and Rural Development Act (7 U.S.C. 8 1926(a)). 9 ‘‘(c) SELF-DETERMINATION CONTRACT.—A self-de- 10 termination contract entered into under subsection (a) 11 shall have the same terms and conditions, and be subject 12 to the same procedures, regulations, and requirements, as 13 a self-determination contract entered into under section 14 102, except that the Secretary of Agriculture and the De- 15 partment of Agriculture shall be the appropriate Secretary 16 and agency for purposes of a self-determination contract 17 entered into under subsection (a). 18 ‘‘(d) TECHNICAL ASSISTANCE.—The Office of Self- 19 Governance of the Bureau of Indian Affairs shall provide 20 technical assistance with respect to a self-determination 21 contract authorized under subsection (a)— 22 ‘‘(1) to the Secretary of Agriculture; and 23 VerDate Sep 11 2014 03:58 Jun 16, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1780.IS S1780 pbinns on DSKJLVW7X2PROD with $$_JOB 4 •S 1780 IS ‘‘(2) to Indian Tribes and Tribal organizations 1 that request that assistance.’’. 2 Æ VerDate Sep 11 2014 03:58 Jun 16, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S1780.IS S1780 pbinns on DSKJLVW7X2PROD with $$_JOB
