District of Columbia Clemency Home Rule Act

AUTHORITY TO GRANT CLEMENCY FOR CRIMES 1 UNDER LAWS OF THE DISTRICT OF COLUM- 2 BIA. 3 (a) AUTHORITY DESCRIBED.—The authority to grant 4 clemency for crimes under the laws of the District of Co- 5 lumbia shall be exercised by such person or persons, and 6 under such terms and conditions, as may be provided 7 under law enacted by the District of Columbia. 8 (b) RULE OF CONSTRUCTION.—Nothing in this Act 9 may be construed— 10 (1) to affect any authority exercised by the 11 President or the Mayor of the District of Columbia 12 prior to the effective date of any law enacted by the 13 District of Columbia pursuant to this Act with re- 14 spect to the authority to grant clemency for crimes 15 under the laws of the District of Columbia; or 16 (2) to limit the authority described in sub- 17 section (a) from being exercised with respect to 18 crimes committed before, on, or after the date of the 19 enactment of this Act. 20 (c) CLEMENCY DEFINED.—In this Act, the term 21 ‘‘clemency’’ means a pardon, reprieve, or commutation of 22 sentence, or a remission of a fine or other financial pen- 23 alty. 24 Æ VerDate Sep 11 2014 23:58 Jun 20, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\H3753.IH H3753 kjohnson on DSK79L0C42PROD with BILLS
