Restoring Vehicle Market Freedom Act of 2023

Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Restoring Vehicle Mar- 4 ket Freedom Act of 2023’’. 5 SEC. 2. REPEAL OF PREVIOUSLY OWNED CLEAN VEHICLE 3 CREDIT. 4 (a) IN GENERAL.—Section 25E is repealed. 5 (b) CONFORMING AMENDMENTS.—Section 6 6213(g)(2) is amended in subparagraph (T) by adding 7 ‘‘and’’ after the comma at the end and by striking sub- 8 paragraph (U). 9 (c) CLERICAL AMENDMENT.—The table of sections 10 for subpart A of part IV of subchapter A of chapter 1 11 is amended by striking the item relating to section 25E. 12 (d) EFFECTIVE DATE.—The amendments made by 13 this section shall apply to vehicles acquired after the date 14 of the enactment of this section. 15 SEC. 4. REPEAL OF NEW QUALIFIED PLUG-IN ELECTRIC 1 DRIVE MOTOR VEHICLE CREDIT. 2 (a) IN GENERAL.—Section 30D is repealed. 3 (b) CONFORMING AMENDMENTS.— 4 (1) Section 38(b) is further amended by strik- 5 ing paragraph (30). 6 (2) Section 166(b)(5)(A)(ii) is amended by in- 7 serting ‘‘(as in effect on the date before the date of 8 the enactment of the Restoring Vehicle Market Free- 9 dom Act of 2023)’’ after ‘‘section 30D(d)(1)’’. 10 (3) Section 179D(d)(3)(B)(ii) is amended by in- 11 serting ‘‘, as in effect on the date before the date 12 of the enactment of the Restoring Vehicle Market 13 Freedom Act of 2023’’ after ‘‘section 30D(g)(9)’’. 14 (4) Section 1016(a) is further amended in para- 15 graph (34) by adding ‘‘and’’ at the end after the 16 comma and by striking paragraph (37). 17 (5) Section 6213(g)(2) is further amended in 18 subparagraph (S) by adding ‘‘and’’ at the end after 19 the comma and by striking subparagraph (T). 20 (6) Section 6417(d)(1)(A)(iv) is amended by in- 21 serting ‘‘, as in effect on the date before the date 22 of the enactment of the Restoring Vehicle Market 23 Freedom Act of 2023’’ after ‘‘section 30D(g)(9)’’. 24 (7) Section 6501(m) is further amended by 25 striking ‘‘30D(e)(4),’’. 26 VerDate Sep 11 2014 23:58 Jun 20, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H3754.IH H3754 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 3754 IH (8) Section 13401 of Public Law 117–169 is 1 amended by striking subsection (j). 2 (c) CLERICAL AMENDMENT.—The table of sections 3 for subpart B of part IV of subchapter A of chapter 1 4 is amended by striking the item relating to section 30D. 5 (d) EFFECTIVE DATE.—The amendments made by 6 this section shall apply to vehicles acquired after the date 7 of the enactment of this section. 8 SEC. 7.
