Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Safe American Food 4 Exports Act of 2023’’ or the ‘‘SAFE Act of 2023’’. 5 SEC. 2. ENGAGEMENT WITH KEY EXPORT MARKETS. 6 (a) IN GENERAL.—Section 10405 of the Animal 7 Health Protection Act (7 U.S.C. 8304) is amended— 8 VerDate Sep 11 2014 23:45 Jun 20, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3748.IH H3748 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 3748 IH (1) by redesignating subsection (d) as sub- 1 section (e); and 2 (2) by inserting after subsection (c) the fol- 3 lowing: 4 ‘‘(d) ENGAGEMENT WITH KEY EXPORT MARKETS.— 5 ‘‘(1) IN GENERAL.—To reduce the impact of 6 animal disease outbreaks on United States exports, 7 the Secretary, acting through the Administrator of 8 the Animal and Plant Health Inspection Service, the 9 Under Secretary of Agriculture for Trade and For- 10 eign Agricultural Affairs, and the Administrator of 11 the Food Safety and Inspection Service, in consulta- 12 tion with the United States Trade Representative, is 13 authorized to negotiate regionalization, zoning, 14 compartmentalization, and other trade agreements 15 regarding outbreaks of known animal disease threats 16 of trade significance with the governments of coun- 17 tries with export markets for livestock animals or 18 animal products from the United States. 19 ‘‘(2) RESEARCH.—A negotiation carried out 20 under paragraph (1) should seek to take into ac- 21 count accepted global research advances.’’. 22 (b) RULE OF CONSTRUCTION.—Nothing in this sec- 23 tion may be construed— 24 VerDate Sep 11 2014 23:45 Jun 20, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3748.IH H3748 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3748 IH (1) to limit the ability of the United States 1 Trade Representative to negotiate trade agreements; 2 or 3 (2) to require the United States Trade Rep- 4 resentative to condition other trade agreements on 5 the inclusion of language relating to reducing the 6 impact of animal disease outbreaks on United States 7 exports, as described in subsection (d)(1) of section 8 10405 of the Animal Health Protection Act (7 9 U.S.C. 3804). 10 SEC. 3.
