Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,
2
SECTION 1. SHORT TITLE.
3
This Act may be cited as the ββYes In My Backyard
4
Actββ.
5
SEC. 2. PURPOSE.
6
The purpose of this Act is to discourage the use of dis-
7
criminatory land use policies and remove barriers to mak-
8
ing housing more affordable in order to further the original
9
intent of the Community Development Block Grant pro-
10
gram.
11
SEC. 3. LAND USE PLAN.
12
(a) IN GENERAL.βSection 104 of the Housing and
13
Community Development Act of 1974 (42 U.S.C. 5304) is
14
amended by adding at the end the following:
15
ββ(n) PLAN TO TRACK AND REDUCE DISCRIMINATORY
16
LAND USE POLICIES.β
17
ββ(1) IN GENERAL.βPrior to receipt in any fiscal
18
year of a grant from the Secretary under subsection
19
(b), (d)(1), or (d)(2)(B) of section 106, each recipient
20
shall have prepared and submitted, not less frequently
21
than once during the preceding 5-year period, in ac-
22
cordance with this subsection and in such standard-
23
ized form as the Secretary shall, by regulation, pre-
24
scribe, with respect to each land use policy described

in paragraph (2) that is applicable to the jurisdiction

served by the recipient, a description ofβ

adopted the policy in the jurisdiction served by

the recipient;

ββ(B) the plan of the recipient to implement

the policy in that jurisdiction; or

ββ(C) the ways in which adopting the policy
8
will benefit the jurisdiction.

ββ(2) LAND
USE
POLICIES.βThe policies de-
10
scribed in this paragraph are as follows:

ββ(A) Enacting high-density single-family
12
and multifamily zoning.
13
ββ(B) Expanding by-right multifamily zoned
14
areas.
15
ββ(C)
Allowing
duplexes,
triplexes,
or
16
fourplexes in areas zoned primarily for single-
17
family residential homes.
18
ββ(D) Allowing manufactured homes in
19
areas zoned primarily for single-family residen-
20
tial homes.
21
ββ(E) Allowing multifamily development in
22
retail, office, and light manufacturing zones.
23
ββ(F) Allowing single-room occupancy devel-
24
opment wherever multifamily housing is allowed.

quirements and other land use policies or re-
3
quirements are coordinated to encourage creation
4
of housing in historic buildings and historic dis-
5
tricts.

ββ(I) Increasing the allowable floor area
7
ratio in multifamily housing areas.
8
ββ(J) Creating transit-oriented development
9
zones.
10
ββ(K) Streamlining or shortening permitting
11
processes and timelines, including through one-
12
stop and parallel-process permitting.
13
ββ(L) Eliminating or reducing off-street
14
parking requirements.
15
ββ(M) Ensuring impact and utility invest-
16
ment fees accurately reflect required infrastruc-
17
ture needs and related impacts on housing af-
18
fordability are otherwise mitigated.
19
ββ(N) Allowing prefabricated construction.
20
ββ(O) Reducing or eliminating minimum
21
unit square footage requirements.
22
ββ(P) Allowing the conversion of office units
23
to apartments.

cluding detached accessory dwelling units, on all

lots with single-family homes.

property height limitations.

able higher density and mixed-income commu-

nities.

SUBMISSION.βA submission

under this subsection shall not be binding with respect
15
to the use or distribution of amounts received under
16
section 106.

ACCEPTANCE
OR
NONACCEPTANCE
OF

PLAN.βThe acceptance or nonacceptance of any plan
19
submitted under this subsection in which the informa-
20
tion required under this subsection is provided is not
21
an endorsement or approval of the plan, policies, or
22
methodologies, or lack thereof.ββ.

(b) EFFECTIVE DATE.βThe requirements under sub-
24
section (n) of section 104 of the Housing and Community
