To amend the Older Americans Act of 1965 to provide
equal treatment of LGBTQI older individuals, and for
other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Ruthie and Connie
4
LGBTQI Elder Americans Act of 2023’’.

SEC. 2. DEFINITIONS.

(a) IN GENERAL.—Section 102 of the Older Ameri-
2
cans Act of 1965 (42 U.S.C. 3002) is amended—
3
(1) in paragraph (24)—
4
(A) in subparagraph (B), by striking
5
‘‘and’’ at the end;
6
(B) in subparagraph (C)(ii), by striking
7
the period and inserting ‘‘; and’’; and
8
(C) by adding at the end the following:
9
‘‘(D) status as an LGBTQI individual and
10
status as an HIV individual.’’;
11
(2) by redesignating—
12
(A) paragraphs (36) through (56) as para-
13
graphs (38) through (59), respectively; and
14
(B) paragraphs (34) and (35) as para-
15
graphs (36) and (37), respectively;
16
(3) by inserting after paragraph (33) the fol-
17
lowing:
18
‘‘(34) The term ‘HIV’, used with respect to an
19
individual, means living with human immuno-
20
deficiency virus;
21
‘‘(35) The term ‘LGBTQI’, used with respect to
22
an individual, means a lesbian, gay, bisexual,
23
transgender, queer, or intersex individual.’’; and
24
(4) by inserting after paragraph (37), as so re-
25
designated, the following:

‘‘(38) The term ‘minority’, used with respect to

an individual, includes a lesbian, gay, bisexual,
2
transgender, queer, or intersex individual.’’.

(b)
CONFORMING
AMENDMENT.—Section
4
215(e)(1)(J) of the Older Americans Act of 1965 (42
5
U.S.C. 3020e–1(e)(1)(J)) is amended by striking ‘‘minori-
6
ties’’ and inserting ‘‘minority individuals’’.

SEC. 3. ADMINISTRATION ON AGING.
8
(a) ESTABLISHMENT OF ADMINISTRATION; OFFICE
9
OF THE LBGTQ INCLUSION.—Section 201 of the Older
10
Americans Act of 1965 (42 U.S.C. 3011) is amended—
11
(1) in subsection (d)(3)(J), by inserting before
12
the semicolon the following: ‘‘, including the effec-
13
tiveness of such services in meeting the needs of
14
LGBTQI older individuals’’; and
15
(2) by adding at the end the following:
16
‘‘(h) The Assistant Secretary is authorized to des-
17
ignate within the Administration a person to have respon-
18
sibility for addressing issues affecting LGBTQI older indi-
19
viduals.
20
‘‘(i)(1) There is established in the Administration an
21
Office of LGBTQI Inclusion (referred to in this subsection
22
as the ‘Office’).

‘‘(2)(A) The Office shall be headed by a Director of
1
LGBTQI Inclusion (referred to in this subsection as the
2
‘Director’) who shall be appointed by the Secretary.
3
‘‘(B) The Office shall include an Assistant Director
4
of LGBTQI Policy (referred to in this subsection as the
5
‘Assistant Director’) who shall be appointed by the Direc-
6
tor to assist the Director in carrying out this subsection,
7
including by carrying out the activities under paragraph
8
(4).

‘‘(3) The Director shall—
10
‘‘(A) coordinate activities within the Depart-
11
ment of Health and Human Services, and between
12
other Federal departments and agencies, to assure a
13
continuum of improved services for LGBTQI older
14
individuals;
15
‘‘(B) promote access to aging services and sup-
16
ports for LGBTQI older individuals;
17
‘‘(C) collect and disseminate information related
18
to the challenges experienced by LGBTQI older indi-
19
viduals; and
20
‘‘(D) administer and evaluate grants that will
21
expand access to aging services and supports for
22
LGBTQI older individuals.

‘‘(4) The Assistant Director shall—

‘‘(A) serve as the effective and visible advocate
1
on behalf of LGBTQI older individuals—
2
‘‘(i) within the Department of Health and
3
Human Services and with other departments
4
and agencies of the Federal Government re-
5
garding all Federal policies affecting such indi-
6
viduals; and
7
‘‘(ii) in the States to promote the enhanced
8
delivery of services and implementation of pro-
9
grams, under this Act and other Federal Acts,
10
for the benefit of such individuals;
11
‘‘(B) support, conduct, and arrange for re-
12
search in the field of LGBTQI aging with a special
13
emphasis on gathering statistics on LGBTQI older
14
individuals;
15
‘‘(C) collect and disseminate information related
16
to challenges experienced by LGBTQI older individ-
17
uals; and
18
‘‘(D) recommend policies and priorities bene-
19
ficial to LGBTQI older individuals and promote the
20
implementation and adoption of culturally competent
21
care and services for such individuals.
22
‘‘(5) Not later than 5 years after the date of enact-
23
ment of this Act and every 5 years thereafter, the Director
24
shall submit to Congress a report describing the activities

carried out under this subsection during the preceding 5
1
years.’’.

(b) FUNCTIONS OF ASSISTANT SECRETARY.—Section
3
202 of the Older Americans Act of 1965 (42 U.S.C. 3012)
4
is amended—
5
(1) in subsection (a)—
6
(A) in paragraph (16)(A)(ii), by inserting
7
‘‘, and separately specifying the number of such
8
individuals who are LGBTQI individuals’’ be-
9
fore the semicolon;
10
(B) in paragraph (33), by striking ‘‘; and’’
11
and inserting a semicolon;
12
(C) in paragraph (34), by striking the pe-
13
riod at the end and inserting ‘‘; and’’; and
14
(D) by adding at the end the following:
15
‘‘(35) conduct studies and collect data to deter-
16
mine the services that are needed by LGBTQI older
17
individuals.’’; and
18
(2) by adding at the end the following:
19
‘‘(j)(1) The Assistant Secretary shall, directly or by
20
grant or contract, establish and operate the National Re-
21
source Center on Lesbian, Gay, Bisexual, Transgender,
22
Queer, and Intersex Aging (in this subsection referred to
23
as the ‘Center’).

‘‘(2) To address the unique challenges faced by
1
LGBTQI older individuals, the Center shall provide na-
2
tional, State, and local organizations, including those with
3
a primary mission of serving LGBTQI individuals and
4
those with a primary mission of serving older individuals,
5
with the information and technical assistance the organi-
6
zations need to effectively serve LGBTQI older individ-
7
uals.
8
‘‘(3) The Center shall have 3 primary objectives, con-
9
sisting of—
10
‘‘(A) educating aging services organizations
11
about the existence and special needs of LGBTQI
12
older individuals;
13
‘‘(B) sensitizing LGBTQI organizations about
14
the existence and special needs of older individuals;
15
and
16
‘‘(C)
providing
educational
resources
to
17
LGBTQI older individuals and their caregivers.
18
‘‘(4)(A) To be eligible to receive funds under this sub-
19
section, an entity—
20
‘‘(i) shall have demonstrated expertise in work-
21
ing with organizations or individuals on issues af-
22
fecting LGBTQI individuals;
23
‘‘(ii) shall have documented experience in pro-
24
viding training and technical assistance on a na-

tional basis or a formal relationship with an organi-
1
zation that has that experience; and
2
‘‘(iii) shall meet such other criteria as the As-
3
sistant Secretary shall issue.
4
‘‘(B) To be eligible to receive funds under this sub-
5
section, an entity shall submit an application to the Assist-
6
ant Secretary at such time, in such manner, and con-
7
taining such information as the Assistant Secretary may
8
require.
9
‘‘(5) The Assistant Secretary shall make available to
10
the Center on an annual basis such resources as are nec-
11
essary for the Center to carry out effectively the functions
12
of the Center under this Act and not less than the amount
13
of resources made available to the National Resource Cen-
14
ter on LGBTQI Aging, existing on the day before the date
15
of enactment of the Ruthie and Connie LGBTQI Elder
16
Americans Act of 2023, for fiscal year 2024.
17
‘‘(6) The Assistant Secretary shall develop and issue
18
operating standards and reporting requirements for the
19
Center.’’.

SEC. 4. GRANTS FOR STATE AND COMMUNITY PROGRAMS
21
ON AGING.
22
Section 301(a)(2) of the Older Americans Act of
23
1965 (42 U.S.C. 3021(a)(2)) is amended—

SEC. 5. ACTIVITIES FOR HEALTH, INDEPENDENCE, AND
9
LONGEVITY.

Section 411(a)(11) of the Older Americans Act of
11
1965 (42 U.S.C. 3032(a)(11)) is amended to read as fol-
12
lows:
13
‘‘(11) conducting activities of national signifi-
14
cance to promote quality and continuous improve-
15
ment in the support and services provided to individ-
16
uals with greatest social need, through activities that
17
include needs assessment, program development and
18
evaluation, training, technical assistance, and re-
19
search, concerning—
20
‘‘(A) addressing physical and mental
21
health, disabilities, and health disparities;
22
‘‘(B) providing long-term care, including
23
in-home and community-based care;

‘‘(C) providing informal care, and formal
1
care in a facility setting;
2
‘‘(D) providing access to culturally respon-
3
sive health and human services; and
4
‘‘(E) addressing other gaps in assistance
5
and issues that the Assistant Secretary deter-
6
mines are of particular importance to older in-
7
dividuals with greatest social need.’’.

SEC. 6. DATA ON DISCRIMINATION.

Section 712 of the Older Americans Act of 1965 (42
10
U.S.C. 3058g) is amended—
11
(1) in subsection (a)(3)—
12
(A) by redesignating subparagraphs (F)
13
through (J) as subparagraphs (G) through (K);
14
and
15
(B) by inserting after subparagraph (E)
16
the following:
17
‘‘(F) collect and analyze data, relating to
18
discrimination against LGBTQI older individ-
19
uals on the basis of actual or perceived sexual
20
orientation, gender identity, or sex characteris-
21
tics (including intersex traits) in the admission
22
to, transfer or discharge from, or lack of ade-
23
quate care provided in long-term care settings,
