Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Kids Fly Safe Act’’. 4 SEC. 2. STUDY AND REPORT ON CHILD SAFETY IN AVIA- 5 TION. 6 (a) STUDY.—The Administrator of the Federal Avia- 7 tion Administration (in this section referred to as the ‘‘Ad- 8 VerDate Sep 11 2014 04:37 Jun 08, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3551.IH H3551 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 3551 IH ministrator’’), in consultation with the Secretary of Health 1 and Human Services, the Commissioner of Food and 2 Drugs, and the Consumer Product Safety Commission, 3 and the Administrator of the Transportation Security Ad- 4 ministration, shall conduct a comprehensive study on child 5 safety in aviation. The study shall include, but not be lim- 6 ited to, evaluation of the following issues: 7 (1) The usage and aircraft compatibility of age- 8 appropriate child safety seats and restraints, includ- 9 ing the different passenger safety and restraint 10 needs of infants, toddlers, and older children with 11 aircraft passenger seating. 12 (2) The procedures for evacuation of children 13 safely and efficiently from a transport category air- 14 plane and the extent to which new or revised age- 15 appropriate requirements are needed. 16 (3) Protection of strollers, child seats, and 17 other child safety equipment while in an aircraft 18 cargo hold. 19 (4) Taking into account other evaluations of 20 airports for compliance with the requirements of the 21 Americans with Disabilities Act of 1990 (42 U.S.C. 22 12101 et seq.), and section 504 of the Rehabilitation 23 Act of 1973 (29 U.S.C. 794), evaluation of the ex- 24 tent to which diaper changing stations and areas 25 VerDate Sep 11 2014 04:37 Jun 08, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3551.IH H3551 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3551 IH designated for breastfeeding are accessible in airport 1 terminals. 2 (5) The extent to which airport terminal design 3 requirements include measures relating to ensuring 4 the general physical safety of children in the ter- 5 minal and while on airport property. 6 (6) The extent to which airport and airline poli- 7 cies protect children from contagious diseases or in- 8 flight respiratory issues. 9 (7) The extent to which the revised training re- 10 quired by section 1950 of the FAA Reauthorization 11 Act of 2018 (49 U.S.C. 44901 note) for Transpor- 12 tation Security Officers related to the screening of 13 passengers with disabilities, including passengers 14 with disabilities who participate in the PreCheck 15 program, and the best practices recommended under 16 subsection (b) of such section, address the proper 17 screening, and any particular sensitivities related to 18 the screening, of passengers who are children with a 19 disability. 20 (b) REPORT.—Not later than 180 after the date of 21 enactment of this Act, the Administrator shall submit to 22 the appropriate committees of Congress a report con- 23 taining the results of the study conducted under sub- 24 VerDate Sep 11 2014 04:37 Jun 08, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3551.IH H3551 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 3551 IH section (a), together with recommendations for such legis- 1 lation as the Administrator determines appropriate. 2 Æ VerDate Sep 11 2014 04:37 Jun 08, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H3551.IH H3551 kjohnson on DSK79L0C42PROD with BILLS
