A BILL
To extend the availability of funds for Emergency Assistance
to Non-Public Schools under the Education Stabilization
Fund and the American Rescue Plan Act of 2021.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘EANS Extension Act’’.

SEC. 2. EXTENDING THE AVAILABILITY OF EANS FUNDS.

(a) EANS I.—Notwithstanding any other provision
6
of law, any funds reserved under section 312(a)(2) of divi-
7
sion M of title III of the Consolidated Appropriations Act,
8
2021 (Public Law 116–260; 134 Stat. 1925) shall remain

ject to the requirements of section 421(b) of the General

Education Provisions Act (20 U.S.C. 1225(b)).

(b) EANS II.—

(1) IN
GENERAL.—Section 2002(a) of the
5
American Rescue Plan Act of 2021 (Public Law
6
117–2; 135 Stat. 23) is amended by striking ‘‘2023’’
7
and inserting ‘‘2024’’.

(2) GEPA.—The amendment made by para-
9
graph (1) shall be subject to the requirements of
10
section 421(b) of the General Education Provisions
11
Act (20 U.S.C. 1225(b)).
