Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Strategic Nuclear In- 4 frastructure Act’’. 5 SEC. 2. STRATEGIC INFRASTRUCTURE FUND WORKING 6 GROUP. 7 (a) ESTABLISHMENT.—There is established a work- 8 ing group, to be known as the ‘‘Strategic Infrastructure 9 VerDate Sep 11 2014 00:54 Jun 06, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3483.IH H3483 pbinns on DSKJLVW7X2PROD with $$_JOB 2 •HR 3483 IH Fund Working Group’’ (referred to in this section as the 1 ‘‘working group’’) to provide input on the feasibility of es- 2 tablishing a program to support strategically important 3 capital-intensive infrastructure projects. 4 (b) COMPOSITION.—The working group shall be— 5 (1) led by a White House official who shall 6 serve as the White House focal point with respect to 7 matters relating to the working group; and 8 (2) composed of— 9 (A) senior-level Federal officials, selected 10 by the head of the applicable Federal agency or 11 organization, from— 12 (i) the Department of State; 13 (ii) the Department of the Treasury; 14 (iii) the Department of Commerce; 15 (iv) the Department of Energy; 16 (v) the Export-Import Bank of the 17 United States; 18 (vi) the United States International 19 Development Finance Corporation; and 2 (C) any senior-level Federal official se- 3 lected by the White House official described in 4 paragraph (1) from any Federal agency or or- 5 ganization. 6 (c) REPORTING.—The working group shall report to 7 the National Security Council. 8 (d) DUTIES.—The working group shall— 9 (1) provide direction and advice to the appro- 10 priate Federal agencies, as determined by the work- 11 ing group, with respect to the establishment of a 12 Strategic Infrastructure Fund (referred to in this 13 subsection as the ‘‘Fund’’) to be used— 14 (A) to support those aspects of projects re- 15 lating to— 16 (i) civil nuclear technologies; and 17 (ii) microprocessors; and 18 (B) for strategic investments identified by 19 the working group; and 20 (2) address critical areas in determining the ap- 21 propriate design for the Fund, including— 22 (A) transfer of assets to the Fund; and 2 (D) governance and implementation of the 3 Fund. 4 (e) REPORT REQUIRED.— 5 (1) IN GENERAL.—Not later than 1 year after 6 the date of the enactment of this Act, the working 7 group shall submit to the committees described in 8 paragraph (2) a report on the findings of the work- 9 ing group that includes suggested legislative text for 10 how to establish and structure a Strategic Infra- 11 structure Fund. 12 (2) COMMITTEES DESCRIBED.—The committees 13 referred to in paragraph (1) are— 14 (A) the Committee on Foreign Relations, 15 the Committee on Commerce, Science, and 16 Transportation, the Committee on Armed Serv- 17 ices, the Committee on Energy and Natural Re- 18 sources, the Committee on Environment and 19 Public Works, and the Committee on Finance 20 of the Senate; and 21 (B) the Committee on Foreign Affairs, the 22 Committee on Energy and Commerce, the Com- 23 mittee on Armed Services, the Committee on 24 Science, Space, and Technology, and the Com- 25 VerDate Sep 11 2014 00:54 Jun 06, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H3483.IH H3483 pbinns on DSKJLVW7X2PROD with $$_JOB 5 •HR 3483 IH mittee on Ways and Means of the House of 1 Representatives. 2 (3) ADMINISTRATION OF THE FUND.—The re- 3 port submitted under paragraph (1) shall include 4 suggested legislative language requiring all expendi- 5 tures from a Strategic Infrastructure Fund estab- 6 lished in accordance with this section to be adminis- 7 tered by the Secretary of State (or a designee of the 8 Secretary of State). 9 (f) CIVIL NUCLEAR DEFINED.—In this section, the 10 term ‘‘civil nuclear’’ means activities relating to— 11 (1) nuclear plant construction; 12 (2) nuclear fuel services; 13 (3) nuclear energy financing; 14 (4) nuclear plant operations; 15 (5) nuclear plant regulation; 16 (6) nuclear medicine; 17 (7) nuclear safety; 18 (8) community engagement in areas in reason- 19 able proximity to nuclear sites;
