Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Saving America’s Fu- 4 ture by Educating Kids Act of 2023’’. 5 SEC. 2. EVIDENCE-BASED CURRICULUM ON SUBSTANCE 6 USE DISORDERS. 7 (a) IN GENERAL.— 8 VerDate Sep 11 2014 03:45 Jun 06, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3521.IH H3521 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 3521 IH (1) DEVELOPMENT AND DISSEMINATION OF 1 CURRICULUM.—The Secretary of Education, in con- 2 sultation with the partners described in paragraph 3 (2), shall develop and disseminate an evidence-based 4 curriculum for kindergarten through grade 12 on 5 educating students at an age-appropriate level on 6 the dangers and harmful impacts of substances that 7 focuses on opioids, vaping, synthetic drugs, and 8 other related substances of misuse. 9 (2) PARTNERS.—The partners described in this 10 paragraph are the following: 11 (A) The Assistant Secretary of the Sub- 12 stance Abuse and Mental Health Services Ad- 13 ministration. 14 (B) The Director of the Centers for Dis- 15 ease Control and Prevention. 16 (C) The Assistant Secretary of the Admin- 17 istration for Children and Families. 18 (D) The Commissioner of Food and Drugs. 19 (E) The Director of the National Institute 20 on Drug Abuse or a designee of the Director 21 from the National Institute on Drug Abuse. 22 (F) The Director of the National Institute 23 on Alcohol Abuse and Alcoholism or a designee 24 VerDate Sep 11 2014 03:45 Jun 06, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3521.IH H3521 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3521 IH of the Director from the National Institute on 1 Alcohol Abuse and Alcoholism. 2 (G) The Administrator of the Office of Ju- 3 venile Justice and Delinquency Prevention of 4 the Department of Justice or a designee of the 5 Administrator from the Office of Juvenile Jus- 6 tice and Delinquency Prevention. 7 (H) The Director of the Office of National 8 Drug Control Policy. 9 (3) ADDITIONAL CONSULTATION.—The Sec- 10 retary of Education may also consult with State 11 educational agencies, local educational agencies, and 12 single State agencies during the development of the 13 evidence-based curriculum under paragraph (1). 14 (4) REVIEW AND UPDATE.—The Secretary of 15 Education, in consultation with the partners de- 16 scribed in paragraph (2), shall review and update 17 the evidence-based curriculum developed under para- 18 graph (1) every 2 years. 19 (b) COMPETITIVE GRANT PROGRAM.— 20 (1) IN GENERAL.—Beginning the first fiscal 21 year following the completion of the development of 22 the evidence-based curriculum under subsection 23 (a)(1), the Secretary of Education, in consultation 24 with the Assistant Secretary for Mental Health and 25 VerDate Sep 11 2014 03:45 Jun 06, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3521.IH H3521 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 3521 IH Substance Use, shall award grants, on a competitive 1 basis, to State educational agencies to enable the 2 State educational agencies to implement the evi- 3 dence-based curriculum. The Secretary of Education 4 shall award not less than 10 grants during each 5 grant cycle. 6 (2) APPLICATION.—A State educational agency 7 that desires to receive a grant under this subsection 8 shall submit an application to the Secretary of Edu- 9 cation at such time, in such manner, and accom- 10 panied by such information as the Secretary may re- 11 quire. 12 (3) PREFERENCE.—In awarding grants under 13 this subsection, the Secretary of Education shall give 14 preference to States that have experienced the high- 15 est drug overdose death rates. 16 (4) SUBCONTRACT.—A State educational agen- 17 cy that receives a grant under this subsection may 18 subcontract with community coalitions that are cur- 19 rently, as of the date of application, a recipient of 20 a grant under section 1032 of the Anti-Drug Abuse 21 Act of 1988 (21 U.S.C. 1532), to implement the evi- 22 dence-based curriculum, as needed. 23 (5) ANNUAL REPORT.—Each State educational 24 agency that receives a grant under this subsection 25 VerDate Sep 11 2014 03:45 Jun 06, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H3521.IH H3521 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 3521 IH shall provide an annual report to the Secretary of 1 Education and the Assistant Secretary for Mental 2 Health and Substance Use on the State educational 3 agency’s curriculum implementation progress and 4 program reach, in order to monitor the quality of 5 implementation of the evidence-based curriculum. 6 (c) DEFINITIONS.—In this section: 7 (1) EVIDENCE-BASED.—The term ‘‘evidence- 8 based’’ has the meaning given the term in section 9 8101 of the Elementary and Secondary Education 10 Act of 1965 (20 U.S.C. 7801). 11 (2) SINGLE STATE AGENCY.—The term ‘‘single 12 State agency’’ means the State agency responsible 13 for administering the substance abuse prevention 14 and treatment block grant under subpart II of part 15 B of title XIX of the Public Health Service Act (42 16 U.S.C. 300x–21 et seq.). 17 (3) STATE EDUCATIONAL AGENCY.—The term 18 ‘‘State educational agency’’ has the meaning given 19 the term in section 8101 of the Elementary and Sec- 20 ondary Education Act of 1965 (20 U.S.C. 7801). 21 (d) FUNDING.—There are authorized to be appro- 22 priated to carry out this section such sums as may be nec- 23 essary for the period of fiscal years 2024 through 2033. 24 Æ VerDate Sep 11 2014 03:45 Jun 06, 2023 Jkt 039200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H3521.IH H3521 kjohnson on DSK79L0C42PROD with BILLS
