Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,
2
SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Motor Carrier Safety
4
Screening Modernization Act’’.
5
SEC. 2. SAFETY PERFORMANCE HISTORY SCREENING.
6
Section 31150 of title 49, United States Code, is
7
amended—
8
(1) in subsection (a) by inserting ‘‘and employ-
9
ment’’ after ‘‘preemployment’’;
10
(2) in subsection (b)—
11
(A) in paragraph (2) by inserting ‘‘operator
12
or’’ before ‘‘operator-applicant’s’’; and
13
(B) by inserting ‘‘operator or’’ before ‘‘oper-
14
ator-applicant’’ each place it appears; and
15
(3) in subsection (c)—
16
(A) by inserting ‘‘or employment’’ after
17
‘‘preemployment’’ each place it appears; and
18
(B) by inserting ‘‘operator or’’ before ‘‘oper-
19
ator-applicant’’.

SEC. 3. DATAQ IMPROVEMENT.

Section 31150 of title 49, United States Code, is
22
amended—
23
(1) by redesignating subsection (d) as subsection
24
(f); and

(2) by inserting after subsection (c) the fol-

lowing:

‘‘(d) DATA SUBJECT TO REVIEW.—Not later than 1
3
year after the date of enactment of the Motor Carrier Safety
4
Screening Modernization Act, the Secretary shall ensure
5
that during any period in which a safety violation is being
6
contested, the report on such violation is labeled in a man-
7
ner that indicates such violation is being contested in the
8
Motor Carrier Management Information System and in
9
any other relevant databases, including the Employment
10
Screening Program, the Safety Measurement System, and
11
Analysis and Information Online, until the review of the
12
contested violation is complete.
13
‘‘(e) DATAQ APPEALS PROCESS.—Not later than 1
14
year after the date of enactment of the Motor Carrier Safety
15
Screening Modernization Act, the Secretary shall promul-
16
gate DataQ program participation guidelines that direct
17
States and other Federal agencies receiving funds under the
18
Motor Carrier Safety Assistance Program to provide for an
19
appeals process by which—
20
‘‘(1) following the conclusion of a request for
21
data review, an affected party may appeal the dis-
22
position of such review; and
