SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Fire Department Re-
2
payment Act of 2023’’.

SEC. 2. REQUIREMENTS RELATING TO CERTAIN FIRE SUP-
4
PRESSION COST SHARE AGREEMENTS.

(a) ESTABLISHMENT
OF
STANDARD
OPERATING
6
PROCEDURES.—Not later than 1 year after the date of
7
the enactment of this section, the Secretaries shall—
8
(1) establish standard operating procedures re-
9
lating to payment timelines for fire suppression cost
10
share agreements established under the Act of May
11
27, 1955 (42 U.S.C. 1856a) (commonly known as
12
the ‘‘Reciprocal Fire Protection Act’’); and
13
(2) with respect to each fire suppression cost
14
share agreement in operation on such date—
15
(A) review each such agreement; and
16
(B) modify each agreement as necessary to
17
comply with the standard operating procedures
18
required under paragraph (1).

(b) ALIGNMENT OF FIRE SUPPRESSION COST SHARE
20
AGREEMENTS WITH COOPERATIVE FIRE PROTECTION
21
AGREEMENTS.—The standard operating procedures re-
22
quired under subsection (a)(1) shall include a requirement
23
that each fire suppression cost share agreement be aligned
24
with each of the cooperative fire protection agreements ap-

plicable to the entity subject to such fire suppression cost

share agreement.

(c) PAYMENTS PURSUANT TO COST SHARE AGREE-
3
MENTS.—With respect to payments made pursuant to fire
4
suppression cost share agreements, the standard operating
5
procedures required under subsection (a)(1) shall require
6
that the Federal paying entity reimburse a local fire de-
7
partment if such fire department submits an invoice in
8
accordance with cost settlement procedures.
9
(d) SENSE OF CONGRESS.—It is the sense of Con-
10
gress that the Secretaries should carry out reciprocal fire
11
suppression cost share agreement repayments to local fire
12
suppression organizations as soon as practicable after fire
13
suppression occurs but not later than 1 year after fire sup-
14
pression occurs.

(e) SECRETARIES DEFINED.—In this section, the
16
term ‘‘Secretaries’’ means—
17
(1) the Secretary of Agriculture;
18
(2) the Secretary of the Interior;
19
(3) the Secretary of Homeland Security; and
