SHORT TITLE. 3 This Act may be cited as the ‘‘Small Businesses before 4 Bureaucrats Act’’. 5 SEC. 2. INCREASE OF DOLLAR THRESHOLD FOR NATIONAL 6 LABOR RELATIONS BOARD JURISDICTION 7 OVER CERTAIN LABOR DISPUTES. 8 (a) IN GENERAL.—Section 14(c) of the National Labor 9 Relations Act (29 U.S.C. 164(c)) is amended— 10 (1) by redesignating paragraph (2) as para- 11 graph (3); and 12 (2) by inserting after paragraph (1) the fol- 13 lowing: 14 ‘‘(2) In establishing by rule any dollar threshold with 15 respect to a class or category of employers for the purposes 16 of declining to assert jurisdiction over certain labor disputes 17 involving such class or category of employers, the Board 18 shall establish such dollar threshold at an amount— 19 ‘‘(A) for calendar year 2024, equal to the product 20 of— 21 ‘‘(i) the dollar threshold applicable to such 22 class or category as of the day prior to the date 23 of enactment of this paragraph, multiplied by 24 ‘‘(ii) ten; and 25 VerDate Sep 11 2014 21:43 Jan 11, 2024 Jkt 049200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6203 E:\BILLS\H3400.RH H3400 4 •HR 3400 RH ‘‘(B) for any calendar year after 2024, equal to 1 the product of— 2 ‘‘(i) the dollar threshold applicable to such 3 class or category for calendar year 2024 (after 4 the date of enactment of this paragraph), multi- 5 plied by 6 ‘‘(ii) the quotient obtained by dividing— 7 ‘‘(I) the Personal Consumption Ex- 8 penditure Per Capita Index (as published 9 by the Bureau of Economic Analysis) for 10 such calendar year after 2024; by 11 ‘‘(II) the Personal Consumption Ex- 12 penditure Per Capita Index for calendar 13 year 2024.’’. 14 (b) PERSONAL CONSUMPTION EXPENDITURE PER CAP- 15 ITA INDEX.—The Bureau of Economic Analysis of the De- 16 partment of Commerce shall prepare and publish an index 17 reflecting expenditures for personal consumption by Ameri- 18 cans on a per capita basis for each year, beginning calendar 19 year 2025, and such index shall be known as the ‘‘Personal 20 Consumption Expenditure Per Capita Index’’. 21 (c) EFFECTIVE DATE.—The amendments made by this 22 section shall apply to any decision of the National Labor 23 Relations Board relating to the assertion of its jurisdiction 24 VerDate Sep 11 2014 21:43 Jan 11, 2024 Jkt 049200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6203 E:\BILLS\H3400.RH H3400 5 •HR 3400 RH over a labor dispute made after the date of enactment of 1 this section. 2 VerDate Sep 11 2014 21:43 Jan 11, 2024 Jkt 049200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6203 E:\BILLS\H3400.RH H3400 Union Calendar No. 281 118TH CONGRESS 2D SESSION H.
