IN THE HOUSE OF REPRESENTATIVES MAY 17, 2023 Ms. GREENE of Georgia (for herself and Mr. GAETZ) submitted the following resolution; which was referred to the Committee on the Judiciary RESOLUTION Impeaching Alejandro Nicholas Mayorkas, Secretary of Homeland Security, for high crimes and misdemeanors. Resolved, That Alejandro Nicholas Mayorkas, Sec- 1 retary of Homeland Security, is impeached for high crimes 2 and misdemeanors, and that the following articles of im- 3 peachment be exhibited to the United States Senate: 4 Articles of impeachment exhibited by the House of 5 Representatives of the United States of America in the 6 name of itself and of the people of the United States of 7 America, against Alejandro Nicholas Mayorkas, Secretary 8 of Homeland Security, in maintenance and support of its 9 VerDate Sep 11 2014 02:10 May 18, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\HR411.IH HR411 pbinns on DSKJLVW7X2PROD with $$_JOB 2 •HRES 411 IH impeachment against him for high crimes and mis- 1 demeanors. 2 ARTICLE I 3 Rather than adhering to an oath he took to defend 4 and secure our country and uphold the Constitution when 5 he was sworn in as Secretary of Homeland Security, 6 Alejandro Nicholas Mayorkas has engaged in a pattern of 7 conduct that is incompatible with the laws of the United 8 States, as follows: 9 Article II of the Constitution requires that the Execu- 10 tive branch, which today includes the Secretary of Home- 11 land Security, ensure the laws passed by Congress and 12 signed into law by the President are faithfully executed. 13 The Secure Fence Act of 2006 (Public Law 109–367) 14 requires that the Secretary of Homeland Security ‘‘main- 15 tain operational control over the entire international land 16 and maritime borders of the United States’’. 17 In his willful admittance of border crossers, terror- 18 ists, human traffickers, drugs, and other contraband, 19 Alejandro Nicholas Mayorkas has failed to maintain oper- 20 ational control of the border, thereby violating the Secure 21 Fence Act of 2006. 22 To wit, since Mayorkas has headed the Department 23 of Homeland Security, during which 0 miles of border wall 24 have been added, there have been— 25 VerDate Sep 11 2014 02:10 May 18, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\HR411.IH HR411 pbinns on DSKJLVW7X2PROD with $$_JOB 3 •HRES 411 IH approximately 6 million illegal border crosser 1 encounters at the southern border; 2 at least 1.4 million known ‘‘gotaways’’; 3 at least 193 people on terrorist watchlists 4 caught while attempting to cross the border at ports 5 of entry; 6 at least 348,812 unaccompanied illegal children 7 encountered at the southern border, with at least 8 85,000 of these children having gone missing; and 9 at least 1,424 deaths of illegals at the southern 10 border. 11 In fiscal year 2021, Customs and Border Patrol 12 (CBP) seized approximately 11.2 thousand pounds of 13 fentanyl. In fiscal year 2022, CBP seized a record of ap- 14 proximately 14.7 thousand pounds of fentanyl. In fiscal 15 year 2023, thus far, CBP has seized almost 14 thousand 16 pounds of fentanyl. Over 70,000 Americans died from 17 fentanyl in fiscal year 2022. Fentanyl is now the number 18 one killer of Americans between the ages of 18 and 45. 19 The Constitution also requires the Secretary of 20 Homeland Security to observe the Immigration and Na- 21 tionality Act (8 U.S.C. 1101 et seq.). This law requires 22 Homeland Security to detain inadmissible aliens arriving 23 in the United States or illegal aliens presently in the 24 United States.
