A BILL
To require the Assistant Secretary of Commerce for Commu-
nications and Information to establish a working group
on performance criteria for radio receivers, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Spectrum Coexistence
4
Act’’.
5
SEC. 2. WORKING GROUP ON PERFORMANCE CRITERIA
6
FOR RADIO RECEIVERS.

(a) ESTABLISHMENT.—

(1) IN
GENERAL.—Not later than 3 months
1
after the date of the enactment of this section, the
2
Secretary of Commerce, in consultation with the As-
3
sistant Secretary of Commerce for Communications
4
and Information and the Commission, shall convene
5
a working group to develop, and periodically update,
6
criteria, ratings, and other measures, including vol-
7
untary standards of radio receivers operating in
8
Federal systems.
9
(2) PURPOSE.—The purpose of the criteria, rat-
10
ings, and other measures, including voluntary stand-
11
ards developed by the working group, shall be to en-
12
courage the design, manufacture, and sale of radio
13
receivers operating in Federal systems that incor-
14
porate appropriate measures to provide interference
15
immunity to ensure that the reasonable current and
16
future use of cochannel or non-cochannel spectrum,
17
including use by non-Federal systems of spectrum
18
designated by the Commission for commercial oper-
19
ations, will not result in receiver operations being se-
20
riously degraded or obstructed, or their operations
21
repeatedly interrupted.

(3) CRITERIA.—In developing the receiver cri-
23
teria, ratings, and other measures, the working
24
group shall take into consideration the unique tech-

nical and operational characteristics of the different

Federal systems.

(b) CHAIR; MEMBERS.—The Chair of the working
3
group shall be the Secretary of Commerce and shall in-
4
clude representatives from the following:
5
(1) The Assistant Secretary.
6
(2) The Commission.
7
(3) The telecommunications industry.
8
(4) Academia.
9
(c) PUBLICATION OF CRITERIA, RATING, AND OTHER
10
MEASURES.—Not later than 18 months after the date on
11
which the working group is established pursuant to sub-
12
section (a)(1), the Commission and Assistant Secretary
13
shall publish the criteria, ratings, and other measures de-
14
veloped pursuant to subsection (a)(1) on a publicly acces-
15
sible page on the website of the National Telecommuni-
16
cations and Information Administration and in the Fed-
17
eral Register.

(d) PERIODIC REVIEW AND UPDATE.—Not less fre-
19
quently than every 4 years, the working group shall review
20
and update, if appropriate, the criteria, ratings, and other
21
measures published pursuant to subsection (c). Any such
22
update shall be published as described in subsection (c)
23
not later than 14 days after the date on which the update
24
is completed.

(e) SAVINGS CLAUSE.—No action taken by the work-
1
ing group, the Assistant Secretary, or the Commission
2
pursuant to this section shall be used to impose any obli-
3
gation on manufacturers with respect to any radio receiv-
4
ers designed to operate exclusively in non-Federal systems.
5
(f) DEFINITIONS.—In this section:
6
(1) ASSISTANT SECRETARY.—The term ‘‘Assist-
7
ant Secretary’’ means the Assistant Secretary of
8
Commerce for Communications and Information.
9
(2) COMMISSION.—The term ‘‘Commission’’
10
means the Federal Communications Commission.
11
(3) FEDERAL
SYSTEM.—The term ‘‘Federal
12
system’’ means a system of radio stations belonging
13
to and operated by the United States that receives
14
radio frequency signals on spectrum that is allocated
15
exclusively for Federal Government use or allocated
16
for both Federal and non-Federal operations.
