A BILL
To amend the Public Health Service Act to expand and
improve health care services by health centers and the
National Health Service Corps for individuals with a
developmental disability, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Healthcare Extension
4
and Accessibility for Developmentally disabled and Under-
5
served Population Act of 2023’’ or the ‘‘HEADs UP Act
6
of 2023’’.

SEC. 2. HEALTH CARE SERVICES BY HEALTH CENTERS AND

NATIONAL HEALTH SERVICE CORPS FOR IN-

DIVIDUALS WITH A DEVELOPMENTAL DIS-

ABILITY.

(a) INCLUSION WITHIN SPECIAL MEDICALLY UN-
5
DERSERVED POPULATIONS FOR PURPOSES OF HEALTH
6
CENTER DEFINITION.—Section 330(a)(1) of the Public
7
Health Service Act (42 U.S.C. 254b(a)(1)) is amended by
8
striking ‘‘or a special medically underserved population
9
comprised of migratory and seasonal agricultural workers,
10
the homeless, and residents of public housing,’’ and insert-
11
ing ‘‘or a special medically underserved population com-
12
prised of migratory and seasonal agricultural workers, the
13
homeless, residents of public housing, and individuals with
14
a developmental disability’’.

(b) DEFINITIONS.—

(1) ADDITIONAL
HEALTH
SERVICES.—Section
17
330(b)(2) of the Public Health Service Act (42
18
U.S.C. 330(b)(2)) is amended—
19
(A) in subparagraph (C), by striking
20
‘‘and’’ at the end;
21
(B) in subparagraph (D), by striking the
22
period at the end and inserting ‘‘; and’’; and
23
(C) by adding at the end the following:
24
‘‘(E) in the case of health centers receiving
25
grants under subsection (j), specially trained

(2) INDIVIDUALS WITH A DEVELOPMENTAL DIS-
4
ABILITY.—Section 330(b) of the Public Health Serv-
5
ice Act (42 U.S.C. 254b(a)(1)) is amended by add-
6
ing at the end the following:

‘‘(4) INDIVIDUALS
WITH
A
DEVELOPMENTAL
8
DISABILITY.—In this section, the term ‘individuals
9
with a developmental disability’ means individuals
10
with a developmental disability as defined in section
11
102 of the Developmental Disabilities Assistance
12
and Bill of Rights Act of 2000.’’.

(c) GRANTS FOR SERVICES.—
14
(1) AUTHORIZATION.—Section 330 of the Pub-
15
lic Health Service Act (42 U.S.C. 254b) is amend-
16
ed—
17
(A)
by
redesignating
subsections
(j)
18
through (r) as subsections (k) through (s), re-
19
spectively; and
20
(B) by inserting after subsection (i) the
21
following:
22
‘‘(j) INDIVIDUALS WITH A DEVELOPMENTAL DIS-
23
ABILITY.—

‘‘(1) IN GENERAL.—The Secretary may award
1
grants for the purposes described in subsections (c),
2
(e), and (f) for the planning and delivery of services
3
to a special medically underserved population com-
4
prised of individuals with a developmental disability,
5
including grants for innovative programs that pro-
6
vide outreach and comprehensive primary health
7
services, including dental care, to individuals with a
8
developmental disability including such individuals
9
who require specialized care.
10
‘‘(2) REQUIRED SERVICES.—In addition to re-
11
quired primary health services (as defined in sub-
12
section (b)(1)), an entity that receives a grant under
13
this subsection shall be required to provide special-
14
ized treatment, as necessary, to individuals with a
15
developmental disability as a condition of such
16
grant.

‘‘(3) SUPPLEMENT
NOT
SUPPLANT
REQUIRE-
18
MENT.—A grant awarded under this subsection shall
19
be expended to supplement, and not supplant, the
20
expenditures of the health center and the value of in
21
kind contributions for the delivery of services to the
22
population described in paragraph (1).’’.

(2) CONFORMING CHANGE.—Section 330(a)(2)
24
of the Public Health Service Act (42 U.S.C.

(d) FUNDING REPORT.—Section 330(r)(3)(A) of the
3
Public Health Service Act (42 U.S.C. 254b(r)(3)(4)) is
4
amended by striking ‘‘and migratory and seasonal agricul-
5
tural workers,’’ and inserting ‘‘migratory and seasonal ag-
6
ricultural workers, and individuals with a developmental
7
disability,’’.

(e) INCLUSION FOR PURPOSES OF HEALTH PROFES-
9
SIONAL SHORTAGE AREAS.—Section 332(a)(3) of the
10
Public Health Service Act is amended by striking ‘‘and
11
residents of public housing (as defined in section 3(b)(1)
12
of the United States Housing Act of 1937 (42 U.S.C.
13
1437a(b)(1)))’’ and inserting ‘‘residents of public housing
14
(as defined in section 3(b)(1) of the United States Hous-
15
ing Act of 1937 (42 U.S.C. 1437a(b)(1))), and individuals
16
with a developmental disability (as defined in section
17
330(b))’’.

SEC. 3. INCLUSION OF COMPREHENSIVE DENTAL TREAT-
19
MENT AS REQUIRED PRIMARY HEALTH SERV-
20
ICES.

Subclause (I) of section 330(b)(1)(A)(i) of the Public
22
Health Service Act (42 U.S.C. 330(b)(1)(A)(i)) is amend-
23
ed by inserting before the semicolon at the end the fol-
24
lowing: ‘‘and services related to dentistry that are fur-
