To amend title XVIII of the Social Security Act to permit a private cause
of action for damages in the case of a group health plan which fails
to provide for primary payment or appropriate reimbursement.

Mr. SCHNEIDER (for himself and Mr. BILIRAKIS) introduced the following bill;
which was referred to the Committee on Ways and Means, and in addi-
tion to the Committee on Energy and Commerce, for a period to be sub-
sequently determined by the Speaker, in each case for consideration of
such provisions as fall within the jurisdiction of the committee concerned

To amend title XVIII of the Social Security Act to permit
a private cause of action for damages in the case of
a group health plan which fails to provide for primary
payment or appropriate reimbursement.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Repair Abuses of MSP
4
Payments Act’’ or the ‘‘RAMP Act’’.

SEC. 2. PRIVATE CAUSE OF ACTION FOR DAMAGES IN THE

OR APPROPRIATE REIMBURSEMENT.

Section 1862(b)(3)(A) of the Social Security Act (42
5
U.S.C. 1395y(b)(3)(A)) is amended by striking ‘‘primary
6
plan’’ and inserting ‘‘group health plan (as defined in
7
paragraph (1)(A)(v))’’.
