No. 3173, § 1, 6-17-2014) 1.02.020 - Provisions deemed as continuations of existing ordinances. (b) The adoption of this Code does not authorize any use or the continuation of any use of a structure or premises in violation of any city ordinance on the effective date of this Code. (Ord. Generally. (1) When provisions conflict, the specific shall prevail over the general. All provisions shall be liberally construed so that the intent of the city council may be effectuated. The provisions of this Code and all proceedings under it are to be liberally construed to affect its purposes and to promote justice. (2) Words and phrases shall be construed according to the common and approved usage of the language, but technical words, technical phrases and words and phrases that have acquired peculiar and appropriate meanings in law shall be construed according to such meanings. (3) Grammatical errors shall not vitiate, and a transposition of words and clauses may be resorted to when the sentence or clause is without meaning as it stands. (4) Scrivener's errors shall be ignored. Charter. The term "charter" means the charter of the City of Henderson, Nevada. City. The term "city" means the City of Henderson, Clark County, Nevada. City council. The terms "city council" and "council" mean the City Council of the City of Henderson, Nevada. Code, ordinance. The term "ordinance" means city ordinance. The term "Code" means the Henderson Municipal Code, as designated in this section. References to the Code are to the Code, as amended. References to ordinances are to ordinances as amended. Computation of time. In computing any period of time prescribed or allowed the day of the act, event, or default from which the designated period of time begins to run shall not be included. The last day of the period so computed shall be included, unless it is a Friday, a Saturday, a Sunday, or a legal holiday day, in which event the period runs until the end of the next day which is not a Friday, Saturday, a Sunday, or legal holiday, or, when the act to be done is the filing of a paper with the city, a day on which weather or other conditions have made the city office in which the paper is to be filed inaccessible, in which event the period runs until the end of the next day which is not one of the aforementioned days. When the period of time prescribed or allowed is less than 11 days, intermediate Fridays, Saturdays, Sundays, and legal holidays shall be excluded in the computation. Conjunctions. In a provision involving two or more items, conditions, provisions or events, which items, conditions, provisions or events are connected by the conjunction "and," "or" or "either….or," the conjunction shall be interpreted as follows unless the context clearly required that the words "and" and "or" be interchangeable: (1) "And" indicates that all the connected terms, conditions, provisions or events apply. (2) "Or" indicates that the connected terms, conditions, provisions or events apply singly or in any combination. (3) "Either...or" indicates that the connected terms, conditions, provisions or events apply singly but not in combination. County. The term "county" means Clark County, Nevada. Delegation of authority. A provision that authorizes or requires a city officer or a city employee to perform an act or make a decision authorizes such officer or employee to act or make a decision through subordinates. Gender. The masculine gender includes the feminine and neuter genders. Health department. The term "health department" means the Southern Nevada Health District. Includes. The term "includes" does not limit a term to a specified example. Joint authority. Words giving a joint authority to three or more persons give such authority to a majority of all such persons. May. The term "may" confers a right, privilege or power. May not. The term "may not" states a prohibition and has a prohibitory effect and abridges or removes a right, privilege or power. Must. The term "must" is to be construed as imposing a requirement. NRS. The abbreviation "NRS" refers to the Nevada Revised Statutes, as now or hereafter amended. Number. Words in the singular include the plural. Words in the plural include the singular. Oath. A solemn affirmation is the equivalent to an oath and a person shall be deemed to have sworn if such person makes such an affirmation. Officers, departments, etc. References to officers, departments, boards, commissions, committees or employees are to city officers, city departments, city boards, city commissions, city committees and city employees. Owner. The term "owner," as applied to property, includes any part owner, joint owner, tenant in common, tenant in partnership, joint tenant or tenant by the entirety of the whole or part of such property. Person. The term "person" means any natural person, any form of business or social organization and any other nongovernmental legal entity including, but not limited to, a corporation, partnership, association, trust or unincorporated organization. The term does not includes a government, governmental agency or political subdivision of a government to the maximum extent permitted by law. Personal property. The term "personal property" means any property other than real property. Premises. The term "premises," as applied to real property, includes land and structures. Property. The term "property" includes real property, personal property and mixed property. Public place. The term "public place" includes any street, sidewalk, park, cemetery, school yard, body or water or watercourse, public conveyance, or any place for the sale of merchandise, public accommodation or amusement. Real property. The term "real property" or "real estate" means property consisting of land and all appurtenances to the land, including buildings and other improvements, fixtures and vegetation erected upon, affixed to, planted in or growing upon the land, and any interest, estate, benefit, right or privilege in such property. Sale. The term "sale" includes any sale, exchange, barter, or offer for sale. Shall. The term "shall" imposes a duty to act. Shall not. The term "shall not" imposes a prohibition against acting. Sidewalk. The term "sidewalk" means that portion of the street between the curb line and the adjacent property line intended for the use of pedestrians. Signature of subscription by mark. The term "signature" or "subscription by mark" include a mark when the signer or subscriber cannot write, such signer's or subscriber's name being written near the mark by a witness who writes his own name near the signer's or subscriber's name; but a signature or subscription by mark can be acknowledged or can serve as a signature or subscription to a sworn statement only when two witnesses so sign their own names thereto. State. The term "State" means the State of Nevada. Street. The term "street" shall mean the entire width between the boundary line of every way publicly maintained when any part thereof is open to the use of the public for vehicular traffic. Tenant or occupant. The terms "tenant" and "occupant," as applied to premises, include any person holding a written or oral lease, or who actually occupies the whole or any part of such premises, alone or with others. Tenses. The present tense includes the past and future tenses. The future tense includes the present tense. Week. The term "week" means a period of seven consecutive days. Will. The term "will" imposes a duty to act. Writing. The term "writing" includes any form of recorded message capable of comprehension by ordinary visual means. Year.
