(Ord. 942 § 1 (part), 1985) 16.06.040 - Permit application. SHARE LINK TO SECTION PRINT SECTION DOWNLOAD (DOCX) OF SECTIONS EMAIL SECTION COMPARE VERSIONS Any person desiring to conduct or manage a special event shall, not less than thirty nor more than one hundred twenty days before the date on which it is proposed to conduct such a special event, file with the Las Vegas metropolitan police department a verified application on a form furnished by the department setting forth the following information: (1) The name, address and telephone number of the applicant and of any other persons, organizations, firms or corporations on whose behalf the application is made and the purpose of the event; (2) The name, address and telephone number of the person who will be the special event chairman and will be responsible for the event; (3) The name, address and telephone number of the person or organization to whom the permit is to be issued; (4) The date or dates when such special event is to be conducted and the time when the special event is to commence and finish; (5) The route to be traveled, the starting point, termination point, and assembly and disassembly area; or other areas to be used; (6) Whether parking is requested or prohibited, and the area to be closed if any; (7) The estimated number of persons who will participate; (8) The estimated number of vehicles and a description of such vehicles which will participate; (9) Whether or not charity, gratuity, or offerings will be solicited or accepted, or sales of food, beverages or other merchandise will occur. (Ord. 942 § 1 (part), 1985) 16.06.050 - Consideration of application and decision. (B) The director of public works, after receipt of the recommendation of the Las Vegas metropolitan police department, shall consider the recommendation and application and shall make such decision thereon as is warranted under the provisions of this chapter. (Ord. 942 § 1 (part), 1985) 16.06.060 - Restriction on streets and times for event. SHARE LINK TO SECTION PRINT SECTION DOWNLOAD (DOCX) OF SECTIONS EMAIL SECTION COMPARE VERSIONS (1) No permit shall be granted to use Las Vegas Boulevard South between Sahara Avenue and Tropicana Avenue except on Saturdays and Sundays and legal holidays between one hour after sunrise and one hour before sunset, due to heavy traffic and no effective alternate route for such traffic. (2) Any application for an event to use any street or highway under control of the state of Nevada Department of Transportation must also have the approval of both the Nevada Highway Patrol and the Department of Transportation. (Ord. 1233 § 1 (part), 1990: Ord. 942 § 1 (part), 1985) 16.06.070 - Permit conditions. SHARE LINK TO SECTION PRINT SECTION DOWNLOAD (DOCX) OF SECTIONS EMAIL SECTION COMPARE VERSIONS No special event permit shall be issued unless the applicant therefor shall obtain and furnish satisfactory proof of either: (A) A comprehensive general liability insurance policy, issued by an insurance company authorized to do business in Nevada with coverage for any claim, demand or action arising from said special event, such policy shall name the county of Clark and Las Vegas metropolitan police department as an additional insured. The policy limits of such insurance shall be not less than the following: EXPAND Property damages ..... $ 100,000 each occurrence Bodily injury or death ..... $ 500,000 each person $1,000,000 each occurrence (B) A comprehensive indemnity bond issued by a surety authorized to do business in Nevada. The indemnity bond shall indemnify the county of Clark and the Las Vegas metropolitan police department against liability for all claims for damage to property or injury to or death of persons arising out of or resulting from the conduct of the special event. (2) The applicant shall be responsible for any and all additional police cost incurred as a consequence of such a special event. The number and type of officers shall be determined and specified by the Las Vegas metropolitan police department to provide for the public safety and protection of public property in and around the area of the special event. (Ord. 942 § 1 (part), 1985) 16.06.090 - Litter collection. Permittee shall be responsible for any and all additional cost incurred by the county of Clark as a consequence of such special event. (Ord. 942 § 1 (part), 1985) 16.06.100 - Claims for damages. SHARE LINK TO SECTION PRINT SECTION DOWNLOAD (DOCX) OF SECTIONS EMAIL SECTION COMPARE VERSIONS Every applicant shall agree to assume the defense of and indemnify and save harmless the Las Vegas metropolitan police department, county of Clark, its boards, commissions, officers, employees and agents, from all suits, actions, damages or claims to which they may be subject of any kind or nature whatsoever resulting from, caused by, arising out of, or as a consequence of such special event and the activities permitted in connection therewith. (Ord. 942 § 1 (part), 1985) 16.06.110 - Compliance. SHARE LINK TO SECTION PRINT SECTION DOWNLOAD (DOCX) OF SECTIONS EMAIL SECTION COMPARE VERSIONS Prior to issuance of a permit under this chapter, all applicable ordinances, rules and regulations shall be complied with and all required permits and licenses shall be secured in connection with such special event, or the proposed activities associated therewith including, but not limited to, charitable solicitations, collections or acceptance of gratuities, the sale of food, beverages or other merchandise, or the use of candles, torches, fires or other combustibles, including pyrotechnics. The Clark County department of business license may require the applicant to obtain any appropriate business license or a bond issued by a surety company authorized to do business in this state to cover any stated prize or gratuity advertised to the contestants of the special event. (Ord. 942 § 1 (part), 1985) 16.06.120 - Conditions for issuance of permit. SHARE LINK TO SECTION PRINT SECTION DOWNLOAD (DOCX) OF SECTIONS EMAIL SECTION COMPARE VERSIONS Any permit granted under this chapter shall contain conditions reasonably calculated to reduce or minimize the dangers and hazards to vehicular or pedestrian traffic and public health, safety, tranquility, morals or welfare, including, but not limited to, changes in time, duration, numbers of participants, or level of sound. (Ord. 942 § 1 (part), 1985) 16.06.130 - Standards for issuance. SHARE LINK TO SECTION PRINT SECTION DOWNLOAD (DOCX) OF SECTIONS EMAIL SECTION COMPARE VERSIONS A permit shall be issued by the metropolitan police department when, from a consideration of application and from such other information as may otherwise be obtained, a finding is made that all of the following circumstances exist: (1) Permit application approved by the following departments or agencies: (a) The metropolitan police department, (b) Clark County public works department, (c) Clark County fire department, (d) Clark County managers office, and (e) Clark County department of business license; (2) Applicant has obtained the insurance or bond as provided by Section 16.06.070; (3) If any state roadway is part of the area to be used for a special event the applicant must obtain any and all necessary permits and approval from the Nevada Department of Transportation and the Nevada Highway Patrol; (4) That the applicant has contracted with the Las Vegas metropolitan police department or agencies approved by said department to provide the necessary additional police service; (5) The applicant has contracted for the proper barricades and warning devices as required in a traffic control plan approved by the Clark County public works department; (6) The applicant has not knowingly or with an intent to deceive, made any false, misleading or fraudulent statement of material fact in the application for a permit or in any other document required pursuant to this chapter; (7) The applicant has met the standards in this chapter, and paid in advance any and all fees required, and agrees to such conditions as are imposed in the permit; (8) The time, duration and size of the special event will not require the diversion of so great a number of police officers as to prevent the normal police protection; (9) The concentration of persons and/or equipment will not unduly interfere with proper fire and police protection, or ambulance service to event area and areas contiguous to such special event; (10) The special event will not unduly interfere with the orderly operation of public roadways, hospitals, parks, schools, or other public and quasipublic institutions in the county; (11) The applicant has provided reasonable means for informing all interested persons and all persons participating in the special event of the terms and conditions of such permit and applicable laws thereto; (12) The special event will not conflict with or interfere with another special event for which a permit has been granted. (Ord. 942 § 1 (part), 1985) 16.06.140 - Notice of issuance or denial.
