SHARE LINK TO SECTION PRINT SECTION DOWNLOAD (DOCX) OF SECTIONS EMAIL SECTION COMPARE VERSIONS From and after June 20, 1967, the Clark County Code, prepared by Book Publishing Company, codifiers, and approved and accepted, shall be the official code of all the ordinances of a general and permanent character of the county of Clark, state of Nevada. (Ord. 268 § 1, 1967) 1.01.020 - Amendments and supplements. SHARE LINK TO SECTION PRINT SECTION DOWNLOAD (DOCX) OF SECTIONS EMAIL SECTION COMPARE VERSIONS There is adopted, as a method of perpetual codification, the loose-leaf type of binding together with the continuous supplemental service whereby each newly adopted ordinance of a general nature amending, altering, adding to, or deleting provisions of the Clark County Code is identified by the proper title or catchline and, following preparation by Book Publishing Company, is inserted in the proper place in each of the official copies. Supplements to the Clark County Code of newly adopted ordinances amending, altering, adding to, or deleting provisions thereof shall be furnished at least once a year. (Ord. 268 § 2, 1967) 1.01.030 - File. (Ord. 268 § 3, 1967) 1.01.040 - General penalty. SHARE LINK TO SECTION PRINT SECTION DOWNLOAD (DOCX) OF SECTIONS EMAIL SECTION COMPARE VERSIONS Whenever in this code or in any ordinance of the county any act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or whenever in such code or ordinance the doing of any act is required or the failure to do any act is declared to be unlawful or a misdemeanor, when no specific penalty is provided therefor, the violation of any such provision of this code or any ordinance shall be punished by a fine not exceeding one thousand dollars or imprisonment for a term not exceeding six months, or by any combination of such fine and imprisonment. However, whenever in this code or in any ordinance of the county regulating parking any act is prohibited or is made or declared to be unlawful or an offense, or whenever in such code or ordinance the doing of any act is required or the failure to do any act is declared to be unlawful, and such ordinance provides that the violation of any particular ordinance incurs a civil liability to the county instead of a criminal sanction, said civil liability shall not be in an amount exceeding one hundred fifty-five dollars. Each day any violation of any provision of this code or of any ordinance continues shall constitute a separate offense. A county employee authorized to serve a citation for a violation of any provision of the Clark County Code, pursuant to NRS 171.17751, is authorized to serve a citation under this section. (Ord. No augmentation shall be made pursuant to this section, if such an augmentation would conflict with state law. The regular meeting occurring on the first Tuesday of each calendar month shall occur at 9:05 a.m. The regular meeting occurring on the third Tuesday of each calendar month shall occur at 9:00 a.m. The first meeting of the board in odd-numbered years must be held on the first Monday in January, or next judicial day if said first Monday is a non-judicial day, as provided in NRS 244.085. SHARE LINK TO SECTION PRINT SECTION DOWNLOAD (DOCX) OF SECTIONS EMAIL SECTION COMPARE VERSIONS Any person violating any of the provisions, or failing to comply with any of the requirements, of Titles 7, 9, 10, 11, 14, 19, 22 or 30 of this code, may be issued a civil administrative citation by any officer within the code enforcement unit authorized to issue misdemeanor citations, or other civil notices, for such violations. Unless a violation specifies another fine amount, the fine schedule for such administrative citation shall be as follows: (a) A fine not exceeding one hundred dollars plus costs for a first violation; (b) A fine not exceeding two hundred and fifty dollars plus costs for a second violation of the same code section within one year of the date of the first offense; and (c) A fine not exceeding five hundred dollars for each additional violation of the same code section within one year of the date of the first offense. (b) Date on which an inspection established the code violation. (c) The code section violated. (d) Address where the code violation was located. (e) Amount of the fine for the violation and procedure to pay the fine. (f) Description of the procedure for requesting an initial review and administrative hearing to contest a citation, including the indigency waiver to the fine deposit requirement. (g) A notice that collection of unpaid fines can be enforced by recording a lien and/or placing a special assessment lien on the tax roll pursuant to NRS 244.3605, against the property where a property related code violation is located and that unpaid assessments can result in the property being sold by the county assessor. (h) A notice that unpaid administrative citation fines will automatically become a lien on the related property and can be recorded on the property after the deadline to appeal the administrative citation or upon a hearing officer upholding the administrative citation. (i) A notice that there is no right to separately appeal the recording of the lien, it must be appealed during any appeal of the administrative citation. (j) An order prohibiting the continuation or repeated occurrence of the code violation described in the administrative citation. (k) Name of the officer issuing the citation. (Ord. The responsible person is required to sign a copy of the citation showing his or her receipt of the citation. If the responsible person served refuses to sign the administrative citation, the refusal to sign shall not affect the validity of the administrative citation or of the subsequent proceedings. The officer shall mark the citation "Refused to sign." (b) An officer may mail the citation by certified mail. The citation shall be mailed certified mail return receipt requested to the responsible person's address shown on the county assessor's records for a property related violation, or to any address known for the cite for all other violations. Simultaneously, the citation shall be sent by first class mail. If the citation is sent by certified mail and returned unsigned, then service shall be deemed effective pursuant to first class mail, provided the citation sent by first class mail is not returned. (c) Service is deemed completed on the date it is personally served or three days from the date the mail is postmarked, whichever occurs first. (Ord. No. 4582, § 1, 5-1-2018; Ord. All fines assessed shall be payable to the Clark County Treasurer. Payment of a fine shall not excuse or discharge a failure to correct continuing violations nor shall it bar further enforcement action by the County. (Ord.
