Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Kids Fly Safe Act’’. 4 SEC. 2. STUDY AND REPORT ON CHILD SAFETY IN AVIA- 5 TION. 6 (a) STUDY.—The Administrator of the Federal Avia- 7 tion Administration (in this section referred to as the ‘‘Ad- 8 ministrator’’), in consultation with the Secretary of Health 9 and Human Services, the Commissioner of Food and 10 VerDate Sep 11 2014 04:37 Jun 08, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S1683.IS S1683 kjohnson on DSK79L0C42PROD with BILLS 2 •S 1683 IS Drugs, and the Consumer Product Safety Commission, 1 and the Administrator of the Transportation Security Ad- 2 ministration, shall conduct a comprehensive study on child 3 safety in aviation. The study shall include, but not be lim- 4 ited to, evaluation of the following issues: 5 (1) The usage and aircraft compatibility of age- 6 appropriate child safety seats and restraints, includ- 7 ing the different passenger safety and restraint 8 needs of infants, toddlers, and older children with 9 aircraft passenger seating. 10 (2) The procedures for evacuation of children 11 safely and efficiently from a transport category air- 12 plane and the extent to which new or revised age- 13 appropriate requirements are needed. 14 (3) Protection of strollers, child seats, and 15 other child safety equipment while in an aircraft 16 cargo hold. 17 (4) Taking into account other evaluations of 18 airports for compliance with the requirements of the 19 Americans with Disabilities Act of 1990 (42 U.S.C. 20 12101 et seq.), and section 504 of the Rehabilitation 21 Act of 1973 (29 U.S.C. 794), evaluation of the ex- 22 tent to which diaper changing stations and areas 23 designated for breastfeeding are accessible in airport 24 terminals. 25 VerDate Sep 11 2014 04:37 Jun 08, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1683.IS S1683 kjohnson on DSK79L0C42PROD with BILLS 3 •S 1683 IS (5) The extent to which airport terminal design 1 requirements include measures relating to ensuring 2 the general physical safety of children in the ter- 3 minal and while on airport property. 4 (6) The extent to which airport and airline poli- 5 cies protect children from contagious diseases or in- 6 flight respiratory issues. 7 (7) The extent to which the revised training re- 8 quired by section 1950 of the FAA Reauthorization 9 Act of 2018 (49 U.S.C. 44901 note) for Transpor- 10 tation Security Officers related to the screening of 11 passengers with disabilities, including passengers 12 with disabilities who participate in the PreCheck 13 program, and the best practices recommended under 14 subsection (b) of such section, address the proper 15 screening, and any particular sensitivities related to 16 the screening, of passengers who are children with a 17 disability. 18 (b) REPORT.—Not later than 180 after the date of 19 enactment of this Act, the Administrator shall submit to 20 the appropriate committees of Congress a report con- 21 taining the results of the study conducted under sub- 22 section (a), together with recommendations for such legis- 23 lation as the Administrator determines appropriate. 24 Æ VerDate Sep 11 2014 04:37 Jun 08, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\S1683.IS S1683 kjohnson on DSK79L0C42PROD with BILLS
