Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. ASSISTANCE AND BENEFITS FOR CERTAIN DRUG- 1 RELATED CONVICTIONS. 2 (a) IN GENERAL.—Section 115 of the Personal Re- 3 sponsibility and Work Opportunity Reconciliation Act of 4 1996 (21 U.S.C. 862a) is amended— 5 (1) in subsection (a), in the matter preceding 6 paragraph (1), by striking ‘‘for—’’ and all that fol- 7 lows through the period at the end of paragraph (2) 8 and inserting ‘‘for assistance under any State pro- 9 gram funded under part A of title IV of the Social 10 Security Act (42 U.S.C. 601 et seq.).’’; 11 (2) in subsection (b)— 12 (A) by striking paragraph (2); 13 (B) by striking the subsection designation 14 and heading and all that follows through ‘‘The 15 amount of’’ in paragraph (1) and inserting the 16 following: 17 ‘‘(b) PROGRAM OF TEMPORARY ASSISTANCE FOR 18 NEEDY FAMILIES.—The amount of’’; and 19 (C) by inserting ‘‘(42 U.S.C. 601 et seq.)’’ 20 after ‘‘Social Security Act’’; and 21 (3) by striking subsection (e) and inserting the 22 following: 23 ‘‘(e) DEFINITION OF STATE.—In this section, the 24 term ‘State’ has the meaning given the term in section 25 419 of the Social Security Act (42 U.S.C. 619), when re- 26 VerDate Sep 11 2014 01:12 Jun 10, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1753.IS S1753 pbinns on DSKJLVW7X2PROD with $$_JOB 3 •S 1753 IS ferring to assistance provided under a State program 1 funded under part A of title IV of the Social Security Act 2 (42 U.S.C. 601 et seq.).’’. 3 (b) EFFECT ON STATE POLICIES.—Any State law, 4 policy, or regulation that imposes conditions on eligibility 5 for the supplemental nutrition assistance program estab- 6 lished under the Food and Nutrition Act of 2008 (7 7 U.S.C. 2011 et seq.) based on an individual having a con- 8 viction for an offense related to a controlled substance 9 shall have no force or effect. 10 (c) MODIFICATION OF DEFINITION OF HOUSEHOLD 11 UNDER SNAP.—Section 3(m)(5) of the Food and Nutri- 12 tion Act of 2008 (7 U.S.C. 2012(m)(5)) is amended by 13 adding at the end the following: 14 ‘‘(F) Incarcerated individuals who are 15 scheduled to be released from an institution 16 within 30 days.’’. 17 Æ VerDate Sep 11 2014 01:12 Jun 10, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\S1753.IS S1753 pbinns on DSKJLVW7X2PROD with $$_JOB
