DUCKWORTH) introduced the following bill; which was read twice and re-
ferred to the Committee on Energy and Natural Resources
A BILL
To direct the Secretary of Energy to establish a grant pro-
gram to facilitate electric vehicle sharing services oper-
ated at public housing projects, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Electric Vehicles for
4
All Act of 2023’’ or the ‘‘EVs for All Act of 2023’’.

SEC. 2. DEPARTMENT OF ENERGY ELECTRIC VEHICLE
6
SHARING SERVICE GRANT PROGRAM.

(a) DEFINITIONS.—In this section:

(1) CHARGER.—The term ‘‘charger’’ means a
1
device with 1 or more charging ports and connectors
2
for charging electric vehicles.
3
(2) ELECTRIC
VEHICLE.—The term ‘‘electric
4
vehicle’’ means a vehicle that derives all of the power
5
of the vehicle from electricity.
6
(3) ELECTRIC
VEHICLE
SHARING
SERVICE.—
7
The term ‘‘electric vehicle sharing service’’ means a
8
service that—
9
(A) allows an individual to apply for a
10
membership that preapproves the individual to
11
rent electric vehicles from the service; and
12
(B) permits preapproved individuals to
13
rent electric vehicles for short periods of time.
14
(4) ELECTRIC VEHICLE SUPPLY EQUIPMENT.—
15
(A) IN GENERAL.—The term ‘‘electric ve-
16
hicle supply equipment’’ means any property,
17
other than a building or a structural component
18
of a building, that is—
19
(i) a charger;
20
(ii) present at the location where elec-
21
tric vehicles are charged; and
22
(iii) available for use by members of
23
the general public.

(B) INCLUSION.—The term ‘‘electric vehi-
1
cle supply equipment’’ includes any utility serv-
2
ice connection, or utility panel upgrade, that is
3
required for the charging of electric vehicles.
4
(5) ELIGIBLE ENTITY.—The term ‘‘eligible enti-
5
ty’’ means—
6
(A) a public housing agency;
7
(B) a unit of local government; and
8
(C) a nonprofit organization that has en-
9
tered into an agreement with a public housing
10
agency or unit of local government under which
11
the public housing agency or unit of local gov-
12
ernment agrees to host an electric vehicle shar-
13
ing service on the property of the public hous-
14
ing agency or unit of local government.
15
(6) FAIR LABOR PRACTICES.—The term ‘‘fair
16
labor practices’’ means practices that comply with
17
applicable labor laws and regulations and provide
18
workers with fair wages, safe working conditions,
19
and protections against discrimination, harassment,
20
and exploitation.
21
(7) FINAL ASSEMBLY.—The term ‘‘final assem-
22
bly’’ means the process by which a manufacturer
23
produces a new electric vehicle at, or through the
24
use of, a plant, factory, or other place from which

the electric vehicle is delivered to a dealer or im-
1
porter with all component parts necessary for the
2
mechanical operation of the electric vehicle included
3
with the electric vehicle, regardless of whether the
4
component parts are permanently installed in or on
5
the electric vehicle.

(8) MAJOR
URBAN
AREA.—The term ‘‘major
7
urban area’’ means a metropolitan statistical area
8
within the United States with an estimated popu-
9
lation of not less than 1,500,000 residents.

NETWORKED
DIRECT
CURRENT
FAST
11
CHARGING EQUIPMENT.—
12
(A) IN GENERAL.—The term ‘‘networked
13
direct current fast charging equipment’’ means
14
electric vehicle charging equipment that—
15
(i) provides a direct current power
16
source at a minimum of 50 kilowatts; and
17
(ii) is enabled to connect to a network
18
to facilitate data collection and access.
19
(B) INCLUSION.—The term ‘‘networked di-
20
rect current fast charging equipment’’ includes
21
a Direct Current Fast Charger.
22
(10) REGISTERED
APPRENTICE.—The term
23
‘‘registered apprentice’’ means a person partici-
24
pating in a program registered pursuant to the Act

tional Apprenticeship Act’’) (50 Stat. 664, chapter
2
663; 29 U.S.C. 50 et seq.).

(11)
SECRETARY.—The
term
‘‘Secretary’’
4
means the Secretary of Energy.
5
(b) ESTABLISHMENT.—Not later than 1 year after
6
the date of enactment of this Act, the Secretary, in coordi-
7
nation with the Secretary of Transportation and the Sec-
8
retary of Housing and Urban Development, shall carry out
9
a program to award grants, on a competitive basis, to fa-
10
cilitate electric vehicle sharing services operated at public
11
housing projects.
12
(c) APPLICATIONS.—An eligible entity seeking a
13
grant under this section shall submit to the Secretary an
14
application in such form, in such manner, and containing
15
such information as the Secretary determines appropriate.
16
(d) CRITERIA FOR GRANT AWARDS.—In awarding
17
grants under this section, the Secretary shall consider the
18
following criteria:
19
(1) The capacity of an eligible entity to operate
20
a proposed electric vehicle sharing service.
21
(2) Whether a proposed electric vehicle sharing
22
service would address—

(A) the infrastructure needs of the public
1
housing project where that electric vehicle shar-
2
ing service will be operated; and
3
(B) the transportation needs of the com-
4
munity surrounding the public housing project.
5
(3) Whether the eligible entity has developed a
6
culturally competent community engagement and
7
education plan for outreach regarding the proposed
8
electric vehicle sharing service.
9
(4) The economic and operational sustainability
10
of the proposed electric vehicle sharing service.
11
(5) Whether the eligible entity proposes to in-
12
stall networked direct current fast charging equip-
13
ment in connection with the proposed electric vehicle
14
sharing service.
15
(6) Whether the eligible entity proposes to pur-
16
chase electric vehicles with respect to which final as-
17
sembly occurred at a location operating under a col-
18
lective bargaining agreement.
19
(7) Whether the eligible entity proposes to pur-
20
chase electric vehicles that—
21
(A) with respect to final assembly, are as-
22
sembled using component parts that are at least
23
50 percent domestic content; and

(B) are powered by battery cells manufac-
1
tured in the United States.
2
(8) Whether the eligible entity proposes to pur-
3
chase electric vehicles from manufacturers that
4
prioritize fair labor practices and worker protections,
5
as demonstrated through certification programs or
6
publicly available reports on the supply chain prac-
7
tices of the manufacturer.
8
(9) Other criteria as determined appropriate by
9
the Secretary.

(e)
PRIORITIZATION
OF
GRANT
AWARDS
TO
11
MARGINALIZED COMMUNITIES.—
12
(1) IN GENERAL.—In awarding grants under
13
this section, the Secretary shall give priority to eligi-
14
ble entities that serve communities that have been
15
historically marginalized or disproportionately im-
16
pacted by environmental injustice.
17
(2) CRITERIA
FOR
PRIORITIZATION.—In car-
18
rying out paragraph (1), the Secretary shall consider
19
the extent to which the proposed public housing
20
project—
21
(A) is located in a community that has—
22
(i) disproportionately high rates of
23
pollution and poor air quality; or

(ii) limited access to affordable trans-
1
portation options; and
2
(B) will benefit from an electric vehicle
3
sharing service, especially with respect to ad-
4
dressing transportation needs and reducing
5
greenhouse gas emissions and criteria air pol-
6
lutants.

(f) PERMITTED GRANT USES.—
8
(1) IN GENERAL.—An eligible entity awarded a
9
grant under this section may only use grant funds
10
for the following activities to facilitate an electric ve-
11
hicle sharing service operated at a public housing
12
project:
13
(A) The purchase of light-duty electric ve-
14
hicles that are not more than 5 years old.
15
(B) The purchase, installation, and main-
16
tenance of electric vehicle supply equipment.
17
(C) Conducting community education and
18
outreach with respect to the electric vehicle
19
sharing service.
20
(D) Providing incentives for residents of
21
the public housing project to use the electric ve-
22
hicle sharing service, including subsidized fares.
23
(E) Maintenance, repairs, and other costs
24
associated with operating the electric vehicle

sharing service, including towing, impound, and
1
driving infraction fines.

(F) Monitoring, data collection, and eval-
3
uation with respect to the electric vehicle shar-
4
ing service.
5
(G) Obtaining technical assistance relating
6
to the establishment, operation, and evaluation
7
of the electric vehicle sharing service.
8
(2) MINIMUM
STANDARDS
FOR
PURCHASED
9
ELECTRIC VEHICLES.—The Secretary shall establish
10
minimum standards relating to functionality and
11
range for electric vehicles eligible to be purchased
12
under paragraph (1)(A).
13
(g) GRANT LIMITATIONS.—
14
(1)
AVAILABILITY.—Grant
funds
awarded
15
under this section to an eligible entity shall be avail-
16
able for obligation or expenditure during the 5-year
17
period beginning on the date on which the grant
18
funds are awarded.
19
(2) MAXIMUM AMOUNT.—
20
(A) IN
GENERAL.—Subject to subpara-
21
graph (B), the amount of a grant under this
22
section shall not be more than $1,000,000 for
23
each public housing project at which the eligible

entity receiving the grant will operate an elec-
1
tric vehicle sharing service.
2
(B) NETWORKED DIRECT CURRENT FAST
3
CHARGING EQUIPMENT.—In the case of a public
4
housing project that includes the installation of
5
networked direct current fast charging equip-
6
ment, the maximum amount of a grant under
7
subparagraph (A) may be increased by $50,000
8
per unit of networked direct current fast charg-
9
ing equipment, for not more than 2 units of
10
networked direct current fast charging equip-
11
ment.

(h) REPORTS.—As a condition of receiving a grant
13
under this section, an eligible entity shall submit to the
14
Secretary, before the end of each year during which the
15
eligible entity receives grant amounts, a report that—
16
(1) describes the activities carried out with the
17
grant amounts; and
18
(2) includes data on—
19
(A) the operating and capital costs for the
20
electric vehicle sharing service facilitated with
21
those grant amounts;
22
(B) the revenue generated by the electric
23
vehicle sharing service;

(C) the daily averages of individual book-
1
ings and hours of electric vehicle use for the
2
electric vehicle sharing service;
3
(D) the number of active users of the elec-
4
tric vehicle sharing service;
5
(E) the distance traveled by the electric ve-
6
hicles of the electric vehicle sharing service;
7
(F) the estimated reduction in greenhouse
8
gas emissions and criteria air pollutants associ-
9
ated with the electric vehicle sharing service;
10
and
11
(G) the results of a survey of customers of
12
the electric vehicle sharing service that provides
13
information on customer preferences, destina-
14
tions, and other information the Secretary de-
15
termines appropriate.

(i) LABOR.—
17
(1) CONTRACTS FOR INSTALLATION OF ELEC-
18
TRIC VEHICLE SUPPLY EQUIPMENT.—As a condition
19
of receiving a grant under this section, an eligible
20
entity shall ensure, to the maximum extent prac-
21
ticable, that—
22
(A) not less than 40 percent of the employ-
23
ees of any nongovernmental entity that enters
24
into a contract with the eligible entity, or a sub-

contract thereof, for the installation of electric
1
vehicle supply equipment are—
2
(i) domiciled—
3
(I) if the installation is carried
4
out at a location in a major urban
5
area, not farther than 15 miles from
6
the location of the installation; or
7
(II) if the installation is not car-
8
ried out at a location in a major
9
urban area, not farther than 50 miles
10
from the location of the installation;
11
(ii) members or veterans of the Armed
12
Forces;
13
(iii) displaced and unemployed energy
14
workers;
15
(iv) registered apprentices who have
16
completed less than 15 percent of the re-
17
quired hours for the apprenticeship pro-
18
gram in which the registered apprentices
19
are enrolled; or
20
(v) persons who—
21
(I) were formerly—
22
(aa) incarcerated in a juve-
23
nile or adult detention or correc-
24
tional facility; or
