A BILL
To amend the Agriculture Improvement Act of 2018 to
reauthorize Forest Service flexible partnerships.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Forest Service Flexible
4
Housing Partnerships Act of 2023’’.
5
SEC. 2. FINDINGS.
6
Congress finds that—
7
(1) housing is a challenge nationwide, especially
8
in areas within or adjacent to forests; and

(2) the Forest Service is a critical partner in
1
addressing housing needs for—
2
(A) individuals in areas described in para-
3
graph (1); and
4
(B) Forest Service employees.

SEC. 3. AUTHORIZATION FOR LEASE OF FOREST SERVICE
6
SITES.
7
Section 8623 of the Agriculture Improvement Act of
8
2018 (16 U.S.C. 580d note; Public Law 115–334) is
9
amended—
10
(1) in subsection (a)(2)(D), by striking ‘‘dwell-
11
ing;’’ and inserting ‘‘dwelling or multiunit dwell-
12
ing;’’;
13
(2) in subsection (e)—
14
(A) in paragraph (3)(B)(ii)—
15
(i) in subclause (I), by inserting ‘‘such
16
as housing,’’ after ‘‘improvements,’’;
17
(ii) in subclause (II), by striking
18
‘‘and’’ at the end;
19
(iii) in subclause (III), by striking
20
‘‘or’’ at the end and inserting ‘‘and’’; and
21
(iv) by adding at the end the fol-
22
lowing:

‘‘(IV) services occurring off of
24
the administrative site—

‘‘(aa) that—
1
‘‘(AA) occur on the unit
2
of the National Forest Sys-
3
tem in which the administra-
4
tive site is located; or
5
‘‘(BB) benefit the Na-
6
tional Forest System; and
7
‘‘(bb) that support activities
8
occurring within the unit of the
9
National Forest System in which
10
the administrative site is located;
11
or’’; and
12
(B) by adding at the end the following:
13
‘‘(6) LEASE TERM.—
14
‘‘(A) IN GENERAL.—The term of a lease of
15
an administrative site under this section shall
16
be up to 100 years.
17
‘‘(B) RENEWAL.—A lease of an adminis-
18
trative site under this section shall include a
19
provision for renewal of the lease if the use of
20
the administrative site, at the time of renewal,
21
is in accordance with this section.’’; and
22
(3) in subsection (i), by striking ‘‘2023’’ each
23
place it appears and inserting ‘‘2028’’.
