grant program under the supplemental nutrition assistance program,
and for other purposes.

Mr. RUBIO introduced the following bill; which was read twice and referred
to the Committee on Agriculture, Nutrition, and Forestry
A BILL
To amend the Food and Nutrition Act of 2008 to modify
the allocation of funding to States for the nutrition edu-
cation and obesity prevention grant program under the
supplemental nutrition assistance program, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ββSNAP Education Allo-
4
cation Modernization Act of 2023ββ.

SEC. 2. NUTRITION EDUCATION AND OBESITY PREVENTION

GRANT PROGRAM.
2
Section 28(d)(2) of the Food and Nutrition Act of
3
2008 (7 U.S.C. 2036a(d)(2)) is amendedβ
4
(1) by striking subparagraph (A) and inserting
5
the following:
6
ββ(A) INITIAL ALLOCATION.βOf the funds
7
set aside under paragraph (1), as determined
8
by the Secretary, subject to a reallocation under
9
subparagraph (B)β
10
ββ(i) for fiscal year 2024β
11
ββ(I) 40 percent shall be allocated
12
to State agencies in direct proportion
13
to the amount of funding that the
14
State received for carrying out this
15
section during fiscal year 2019; and
16
ββ(II) 60 percent shall be allo-
17
cated to State agencies based on the
18
respective share of each State of the
19
number of individuals participating in
20
the supplemental nutrition assistance
21
program during the 12-month period
22
ending the preceding January 31;
23
ββ(ii) for fiscal year 2025β
24
ββ(I) 30 percent shall be allocated
25
to State agencies in direct proportion

ββ(iii) for fiscal year 2026β

ββ(I) 20 percent shall be allocated

to State agencies in direct proportion

to the amount of funding that the

State received for carrying out this

section during fiscal year 2019; and

ββ(II) 80 percent shall be allo-
17
cated to State agencies based on the
18
respective share of each State of the
19
number of individuals participating in
20
the supplemental nutrition assistance
21
program during the 12-month period
22
ending the preceding January 31;

ββ(iv) for fiscal year 2027β

of individuals participating in the supple-

mental nutrition assistance program dur-
18
ing the 12-month period ending the pre-
19
ceding January 31.ββ; and
20
(2) in subparagraph (B)(ii), by striking ββ2009ββ
21
each place it appears and inserting ββ2019ββ.
