Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. NUTRITION EDUCATION AND OBESITY PREVENTION 1 GRANT PROGRAM. 2 Section 28(d)(2) of the Food and Nutrition Act of 3 2008 (7 U.S.C. 2036a(d)(2)) is amended— 4 (1) by striking subparagraph (A) and inserting 5 the following: 6 ‘‘(A) INITIAL ALLOCATION.—Of the funds 7 set aside under paragraph (1), as determined 8 by the Secretary, subject to a reallocation under 9 subparagraph (B)— 10 ‘‘(i) for fiscal year 2024— 11 ‘‘(I) 40 percent shall be allocated 12 to State agencies in direct proportion 13 to the amount of funding that the 14 State received for carrying out this 15 section during fiscal year 2019; and 16 ‘‘(II) 60 percent shall be allo- 17 cated to State agencies based on the 18 respective share of each State of the 19 number of individuals participating in 20 the supplemental nutrition assistance 21 program during the 12-month period 22 ending the preceding January 31; 23 ‘‘(ii) for fiscal year 2025— 24 ‘‘(I) 30 percent shall be allocated 25 to State agencies in direct proportion 26 VerDate Sep 11 2014 00:52 May 31, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1660.IS S1660 kjohnson on DSK79L0C42PROD with BILLS 3 •S 1660 IS to the amount of funding that the 1 State received for carrying out this 2 section during fiscal year 2019; and 3 ‘‘(II) 70 percent shall be allo- 4 cated to State agencies based on the 5 respective share of each State of the 6 number of individuals participating in 7 the supplemental nutrition assistance 8 program during the 12-month period 9 ending the preceding January 31; 10 ‘‘(iii) for fiscal year 2026— 11 ‘‘(I) 20 percent shall be allocated 12 to State agencies in direct proportion 13 to the amount of funding that the 14 State received for carrying out this 15 section during fiscal year 2019; and 16 ‘‘(II) 80 percent shall be allo- 17 cated to State agencies based on the 18 respective share of each State of the 19 number of individuals participating in 20 the supplemental nutrition assistance 21 program during the 12-month period 22 ending the preceding January 31; 23 ‘‘(iv) for fiscal year 2027— 24 VerDate Sep 11 2014 00:52 May 31, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1660.IS S1660 kjohnson on DSK79L0C42PROD with BILLS 4 •S 1660 IS ‘‘(I) 10 percent shall be allocated 1 to State agencies in direct proportion 2 to the amount of funding that the 3 State received for carrying out this 4 section during fiscal year 2019; and 5 ‘‘(II) 90 percent shall be allo- 6 cated to State agencies based on the 7 respective share of each State of the 8 number of individuals participating in 9 the supplemental nutrition assistance 10 program during the 12-month period 11 ending the preceding January 31; and 12 ‘‘(v) for fiscal year 2028 and each fis- 13 cal year thereafter, 100 percent shall be al- 14 located to State agencies based on the re- 15 spective share of each State of the number 16 of individuals participating in the supple- 17 mental nutrition assistance program dur- 18 ing the 12-month period ending the pre- 19 ceding January 31.’’; and 20 (2) in subparagraph (B)(ii), by striking ‘‘2009’’ 21 each place it appears and inserting ‘‘2019’’. 22 Æ VerDate Sep 11 2014 00:52 May 31, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S1660.IS S1660 kjohnson on DSK79L0C42PROD with BILLS
