ONE FEDERAL DECISION FOR PORTS. 3 (a) IN GENERAL.—Chapter 543 of title 46, United 4 States Code, is amended by adding at the end the fol- 5 lowing: 6 ‘‘§ 54302. Efficient environmental reviews and one 7 Federal decision 8 ‘‘(a) EFFICIENT ENVIRONMENTAL REVIEWS.— 9 ‘‘(1) IN GENERAL.—The Secretary of Transpor- 10 tation shall apply the project development proce- 11 dures, to the greatest extent feasible, described in 12 section 139 of title 23 to any port infrastructure 13 project that requires the approval of the Secretary 14 under the National Environmental Policy Act of 15 1969 (42 U.S.C. 4321 et seq.). 16 ‘‘(2) REGULATIONS AND PROCEDURES.—In car- 17 rying out paragraph (1), the Secretary shall incor- 18 porate into agency regulations and procedures per- 19 taining to port infrastructure projects described in 20 paragraph (1) aspects of such project development 21 procedures, or portions thereof, determined appro- 22 priate by the Secretary in a manner consistent with 23 this section, that increase the efficiency of the review 24 of port infrastructure projects. 25 VerDate Sep 11 2014 00:24 Dec 20, 2024 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3316.RH H3316 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 3316 RH ‘‘(3) DISCRETION.—The Secretary may choose 1 not to incorporate into agency regulations and proce- 2 dures pertaining to port infrastructure projects de- 3 scribed in paragraph (1) such project development 4 procedures that could only feasibly apply to highway 5 projects, public transportation capital projects, and 6 multimodal projects. 7 ‘‘(4) APPLICABILITY.—Subsection (l) of section 8 139 of title 23 shall apply to port infrastructure 9 projects described in paragraph (1), except that the 10 limitation on claims of 150 days shall be 2 years. 11 ‘‘(b) ADDITIONAL CATEGORICAL EXCLUSIONS.—The 12 Secretary shall maintain and make publicly available, in- 13 cluding on the Internet, a database that identifies project- 14 specific information on the use of a categorical exclusion 15 on any port infrastructure project carried out under this 16 title.’’. 17 (b) CLERICAL AMENDMENT.—The analysis for chap- 18 ter 543 of title 46, United States Code, is amended by 19 adding at the end the following: 20 ‘‘54302. Efficient environmental reviews and one Federal decision.’’. SEC. 2.
