SHORT TITLE. 3 This Act may be cited as the ‘‘Artificial Intelligence 4 Accountability Act’’ or the ‘‘AI Accountability Act’’. 5 SEC. 2. STUDY ON ACCOUNTABILITY MEASURES FOR ARTI- 6 FICIAL INTELLIGENCE SYSTEMS. 7 (a) STUDY.—The Assistant Secretary of Commerce for 8 Communications and Information shall conduct a study on 9 accountability measures for artificial intelligence systems, 10 which shall include an analysis of the following: 11 (1) How accountability measures are being in- 12 corporated into artificial intelligence systems used by 13 communications networks (including telecommuni- 14 cations networks and social media platforms) and 15 electromagnetic spectrum sharing applications. 16 (2) How accountability measures for artificial 17 intelligence systems can facilitate the closing of the 18 digital divide and assist the promotion of digital in- 19 clusion in the United States. 20 (3) How accountability measures may reduce 21 risks related to artificial intelligence systems, includ- 22 ing cybersecurity risks. 23 (4) How the term ‘‘trustworthy’’ is used and de- 24 fined in the context of artificial intelligence, includ- 25 VerDate Sep 11 2014 03:50 Oct 26, 2023 Jkt 049200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6203 E:\BILLS\H3369.RH H3369 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 3369 RH ing how the term may be applied in various contexts 1 related to artificial intelligence. 2 (5) The relationship, with respect to artificial 3 intelligence, between the term ‘‘trustworthy’’ and other 4 terms such as ‘‘responsible’’ and ‘‘human-centric’’. 5 (b) STAKEHOLDER CONSULTATION.—In carrying out 6 the study required by subsection (a), the Assistant Secretary 7 shall hold public meetings to consult with relevant stake- 8 holders for the purpose of soliciting feedback on account- 9 ability measures for artificial intelligence systems. 10 (c) REPORT.—Not later than 18 months after the date 11 of the enactment of this Act, the Assistant Secretary shall 12 submit to the Committee on Energy and Commerce of the 13 House of Representatives and the Committee on Commerce, 14 Science, and Transportation of the Senate a report on the 15 results of the study required by subsection (a) that shall 16 include— 17 (1) the results of the analysis required by sub- 18 section (a); 19 (2) a description of the feedback provided during 20 the meetings required by subsection (b); and 21 (3) recommendations for governmental and non- 22 governmental actions to support effective account- 23 ability measures for artificial intelligence systems. 24 VerDate Sep 11 2014 03:50 Oct 26, 2023 Jkt 049200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6203 E:\BILLS\H3369.RH H3369 kjohnson on DSK7ZCZBW3PROD with $$_JOB 5 •HR 3369 RH (d) ACCOUNTABILITY MEASURE DEFINED.—In this 1 section, the term ‘‘accountability measure’’ means a mecha- 2 nism, including an audit, an assessment, or a certification, 3 designed to provide assurance that a system is trustworthy. 4 SEC. 3.
