To require the Secretary of Veterans Affairs to publish a
rule to implement the requirement that the Secretary
be permitted to waive the limitation in law on reimburse-
ment of veterans receiving domiciliary care in State
homes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Reimburse Veterans
4
for Domiciliary Care Act’’.

SEC. 2. PUBLICATION OF RULE FOR WAIVER ON LIMITA-

TION OF PAYMENTS TO STATE HOMES FOR

DOMICILIARY
CARE
PROVIDED

(a) PROPOSED RULE.—Not later than 90 days after
5
the date of the enactment of this Act, the Secretary of
6
Veterans Affairs shall prescribe and publish in the Federal
7
Register a proposed rule implementing the requirement
8
under section 3007(a) of the Johnny Isakson and David
9
P. Roe, M.D. Veterans Health Care and Benefits Improve-
10
ment Act of 2020 (Public Law 116–315; 38 U.S.C. 1741
11
note).

(b) FINAL RULE.—Not later than 180 days after the
13
publication of the initial rule required under subsection
14
(a), or the date that is 260 days after the date of the
15
enactment of this Act, whichever occurs first, the Sec-
16
retary shall prescribe and publish in the Federal Register
17
a final rule implementing the requirement specified in
18
such subsection.

(c) RETROACTIVE PAYMENTS.—In prescribing the
20
proposed rule under subsection (a) and the final rule
21
under subsection (b), the Secretary shall ensure that the
22
authority of the Secretary to provide payments to State
23
homes (as defined in section 101(19) of title 38, United
