Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Uyghur Genocide In- 4 telligence Review Act’’. 5 SEC. 2. ANNUAL REPORT BY DIRECTOR OF NATIONAL IN- 6 TELLIGENCE ON UYGHUR GENOCIDE. 7 (a) COLLECTION.—The heads of the elements of the 8 intelligence community shall take such steps as may be 9 VerDate Sep 11 2014 03:17 May 30, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3349.IH H3349 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 3349 IH necessary to ensure the timely and effective collection of 1 intelligence relating to the Uyghur genocide. 2 (b) ANNUAL REPORT ON UYGHUR GENOCIDE.— 3 (1) SUBMISSION.—Not later than 180 days 4 after the date of the enactment of this Act, and an- 5 nually thereafter until such time as the President (in 6 consultation with the Director of National Intel- 7 ligence and the Secretary of State) determines the 8 Uyghur genocide is no longer a matter of concern, 9 the Director of National Intelligence, in coordination 10 with the relevant heads of the elements of the intel- 11 ligence community, shall submit to the congressional 12 intelligence committees a report on the Uyghur 13 genocide, including an analysis of any intelligence 14 collected pursuant to subsection (a). 15 (2) MATTERS.—Each report under paragraph 16 (1) shall address the following matters: 17 (A) Forced sterilization, forced birth con- 18 trol, and forced abortion of Uyhghurs. 19 (B) Forced transfer of Uyghur children 20 from their families. 21 (C) Forced labor of Uyghurs, inside and 22 outside of Xinjiang. 23 (D) The work conditions of Uyghur labor- 24 ers (including laborers in the textile, automobile 25 VerDate Sep 11 2014 03:17 May 30, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3349.IH H3349 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3349 IH and electric vehicle, solar panel, polyvinyl chlo- 1 ride, and rare earth metals sectors), including 2 an identification of any company that is— 3 (i) organized under the laws of the 4 People’s Republic of China or otherwise 5 subject to the jurisdiction of (or over which 6 control is exercised or exercisable by) the 7 Government of the People’s Republic of 8 China; and 9 (ii) employing forced Uyghur laborers 10 from Xinjiang. 11 (E) Any other forms of physical or psycho- 12 logical torture against Uyghurs. 13 (F) Any other actions that infringe on the 14 rights of Uyghurs to live freely in accordance 15 with their customs, culture, and religious prac- 16 tices. 17 (G) The methods of surveillance of 18 Uyghurs, including surveillance via technology, 19 law enforcement notifications, and forcing 20 Uyghurs to live with other individuals for moni- 21 toring purposes. 22 (H) Such other matters as the Director of 23 National Intelligence may determine appro- 24 priate. 25 VerDate Sep 11 2014 03:17 May 30, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3349.IH H3349 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 3349 IH (3) FORM.—Each report under paragraph (1) 1 shall be submitted in unclassified form, but may in- 2 clude a classified annex. 3 (c) DEFINITIONS.—In this section, the terms ‘‘con- 4 gressional intelligence committees’’, ‘‘intelligence’’, ‘‘intel- 5 ligence community’’, and ‘‘national intelligence’’ have the 6 meanings given those terms in section 3 of the National 7 Security Act of 1947 (50 U.S.C. 3003). 8 Æ VerDate Sep 11 2014 03:17 May 30, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H3349.IH H3349 kjohnson on DSK79L0C42PROD with BILLS
