Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. APPLICATION OF NEPA AND NHPA TO COVERED 3 COMMUNICATIONS EQUIPMENT OR SERV- 4 ICES. 5 (a) NEPA EXEMPTION.—A Federal authorization 6 with respect to a covered project may not be considered 7 a major Federal action under section 102(2)(C) of the Na- 8 tional Environmental Policy Act of 1969 (42 U.S.C. 9 4332(2)(C)). 10 (b) NATIONAL HISTORIC PRESERVATION ACT EX- 11 EMPTION.—A covered project may not be considered an 12 undertaking under section 300320 of title 54, United 13 States Code. 14 (c) DEFINITIONS.—In this section: 15 (1) COVERED PROJECT.—The term ‘‘covered 16 project’’ means a project to permanently remove cov- 17 ered communications equipment or services (as de- 18 fined in section 9 of the Secure and Trusted Com- 19 munications Networks Act of 2019 (47 U.S.C. 20 1608)) and to replace such covered communications 21 equipment or services with communications equip- 22 ment or services (as defined in such section) that are 23 not covered communications equipment or services 24 (as so defined). 25 VerDate Sep 11 2014 00:50 May 27, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3280.IH H3280 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3280 IH (2) FEDERAL AUTHORIZATION.—The term 1 ‘‘Federal authorization’’— 2 (A) means any authorization required 3 under Federal law with respect to a covered 4 project; and 5 (B) includes any permits, special use au- 6 thorizations, certifications, opinions, or other 7 approvals as may be required under Federal law 8 with respect to a covered project. 9 Æ VerDate Sep 11 2014 00:50 May 27, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H3280.IH H3280 kjohnson on DSK79L0C42PROD with BILLS
