ELIMINATING RENEWABLE FUEL STANDARD AD- 1 VANCED BIOFUEL CORN STARCH PROHIBI- 2 TION. 3 (a) ADVANCED BIOFUEL DEFINITION.—Section 4 211(o)(1)(B) of the Clean Air Act (42 U.S.C. 5 7545(o)(1)(B)) is amended— 6 (1) in clause (i), by striking ‘‘, other than eth- 7 anol derived from corn starch,’’; and 8 (2) in subclause (ii)(II), by striking ‘‘(other 9 than corn starch)’’ and inserting ‘‘, including corn 10 starch’’. 11 (b) CONFORMING CHANGE.—Section 211(o)(1) of the 12 Clean Air Act (42 U.S.C. 7545(o)(1)) is amended by strik- 13 ing subparagraph (F) (relating to the definition of conven- 14 tional biofuel). 15 (c) APPLICABILITY.—The amendments made by sub- 16 sections (a) and (b) shall apply beginning with the first 17 calendar year that begins after the date of enactment of 18 this Act. 19 SEC. 3. GREENHOUSE GAS EMISSIONS FROM CORN-BASED 20 ETHANOL AND BIOMASS-BASED DIESEL. 21 (a) IN GENERAL.—Subject to subsection (b), not 22 later than 90 days after the date of enactment of this Act, 23 and every 5 years thereafter, the Administrator of the En- 24 vironmental Protection Agency (in this section referred to 25 as the ‘‘Administrator’’) shall update the methodology 26 VerDate Sep 11 2014 00:55 May 30, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3337.IH H3337 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3337 IH used by the Environmental Protection Agency in lifecycle 1 analyses with respect to— 2 (1) greenhouse gas emissions that result from 3 ethanol derived from corn starch; and 4 (2) greenhouse gas emissions that result from 5 biomass-based diesel (as defined in section 6 211(o)(1)(D) of the Clean Air Act (42 U.S.C. 7 7545(o)(1)(D)). 8 (b) REQUIREMENTS.— 9 (1) FIRST UPDATE.—In carrying out the first 10 update required under subsection (a), the Adminis- 11 trator shall adopt the most recent Greenhouse 12 Gases, Regulated Emissions, and Energy Use in 13 Transportation model (commonly referred to as the 14 ‘‘GREET model’’) developed by Argonne National 15 Laboratory. 16 (2) SUBSEQUENT UPDATES.—In carrying out 17 the second and each subsequent update required 18 under subsection (a), the Administrator shall— 19 (A) as necessary, adopt, review, or update 20 a methodology determined to be appropriate by 21 the Administrator; or 22 (B) adopt the methodology described in 23 paragraph (1). 24 Æ VerDate Sep 11 2014 00:55 May 30, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H3337.IH H3337 kjohnson on DSK79L0C42PROD with BILLS
