To require the Secretary of Energy to receive approval from the Secretary
of Housing and Urban Development with respect to manufactured hous-
ing energy efficiency standards issued by the Secretary of Energy, and
for other purposes.

which was referred to the Committee on Energy and Commerce, and in
addition to the Committee on Financial Services, for a period to be subse-
quently determined by the Speaker, in each case for consideration of such
provisions as fall within the jurisdiction of the committee concerned

To require the Secretary of Energy to receive approval from
the Secretary of Housing and Urban Development with
respect to manufactured housing energy efficiency stand-
ards issued by the Secretary of Energy, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Manufactured Housing
4
Affordability and Energy Efficiency Act of 2023’’.

SEC. 2. CLARIFICATION OF HUD FINAL AUTHORITY OVER

MANUFACTURED
HOUSING
ENERGY
EFFI-

CIENCY STANDARDS.

Section 413 of the Energy Independence and Security
4
Act of 2007 (42 U.S.C. 17071) is amended by inserting
5
the following new subsection:
6
‘‘(d) FINAL HUD AUTHORITY.—The manufactured
7
housing energy efficiency standards developed by the Sec-
8
retary of Energy under subsection (a) shall be considered
9
by the Secretary of the Department of Housing and Urban
10
Development under section 604(a) of the National Manu-
11
factured Housing Construction and Safety Standards Act
12
of 1974 (42 U.S.C. 5401 et seq.) and shall only become
13
effective and enforceable, under subsection (c) or other-
14
wise, if and in the form adopted into the Manufactured
15
Housing Construction and Safety Standards (24 C.F.R.
16
3280) pursuant to section 604(a) of such Act.’’.

SEC. 3. ELIMINATION OF INAPPROPRIATE USE OF IECC.

Section 413(b) of the Energy Independence and Se-
19
curity Act of 2007 (42 U.S.C. 17071(b)) is amended to
20
read as follows:

‘‘(b) REQUIREMENTS.—The energy conservation
22
standards established under this section may be based on
23
the climate zones established by the Department of Hous-
24
ing and Urban Development.’’.

SEC. 4. SUPREMACY OF HUD CODE.

Section 604 of the National Manufactured Housing
2
Construction and Safety Standards Act of 1974 (42
3
U.S.C. 5403) is amended by inserting the following new
4
subsection:

‘‘(i) EXCLUSIVE AUTHORITY OVER MANUFACTURED
6
HOUSING ENERGY STANDARDS.—Any construction or
7
safety standard developed by other Federal agencies, in-
8
cluding energy standards developed pursuant to section
9
413 of the Energy Independence and Security Act of 2007
10
(42 U.S.C. 17071), shall only become effective and en-
11
forceable by HUD or such other agency if and in the form
12
adopted into the construction and safety standards estab-
13
lished under subsection (a).’’.
