To amend title XVIII of the Social Security Act to permit
a private cause of action for damages in the case of
a group health plan which fails to provide for primary
payment or appropriate reimbursement.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Repair Abuses of MSP
4
Payments (RAMP) Act’’.

SEC. 2. PRIVATE CAUSE OF ACTION FOR DAMAGES IN THE

CASE OF A GROUP HEALTH PLAN WHICH

FAILS TO PROVIDE FOR PRIMARY PAYMENT

OR APPROPRIATE REIMBURSEMENT.

Section 1862(b)(3)(A) of the Social Security Act (42
5
U.S.C. 1395y(b)(3)(A)) is amended by striking ‘‘primary
6
plan’’ and inserting ‘‘group health plan (as defined in
7
paragraph (1)(A)(v))’’.
