A BILL
To direct the Director of the Bureau of Prisons to place
certain individuals in the custody of the Bureau of Pris-
ons within 250 miles of the District of Columbia, and
for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Improving Reentry for
4
District of Columbia Residents in the Bureau of Prisons
5
Act of 2023’’.

SEC. 2. PLACEMENT NEAR DISTRICT OF COLUMBIA FOR

CERTAIN INDIVIDUALS IN CUSTODY OF BU-
2
REAU OF PRISONS.

(a) IN GENERAL.—Beginning not later than two
4
years after the date of enactment of this Act, the Director
5
of the Bureau of Prisons shall not place a covered indi-
6
vidual in a Bureau of Prisons facility that is located more
7
than 250 miles from the District of Columbia, unless such
8
individual requests or consents to such a placement.

(b) EXTRAORDINARY CIRCUMSTANCES.—
10
(1) IN GENERAL.—Notwithstanding subsection
11
(a), the Director may place a covered individual in
12
a Bureau of Prisons facility that is more than 250
13
miles from the District of Columbia if the Director
14
determines that extraordinary circumstances war-
15
rant such a placement.
16
(2) REPORT REQUIRED.—Not longer than 30
17
days after a placement under paragraph (1), the Di-
18
rector shall provide a written explanation to the cov-
19
ered congressional committees on the extraordinary
20
circumstances warranting such a placement.

(c) RULE OF CONSTRUCTION.—Nothing in this Act
22
may be constructed to prohibit the Director from placing
23
a covered individual in prerelease custody pursuant to sec-
24
tion 3624(g)(2) of title 18, United States Code, or on
25
transferring an individual to begin a term of supervised

release pursuant to section 3624(g)(3) of title 18, United

States Code.

(d) DEFINITIONS.—In this section:

(1) COVERED CONGRESSIONAL COMMITTEES.—
4
The term ‘‘covered congressional committees’’ means
5
the Committee on the Judiciary and the Committee
6
on Oversight and Reform of the House of Represent-
7
atives and the Committee on the Judiciary and the
8
Committee on Homeland Security and Governmental
9
Affairs of the Senate.

(2) COVERED INDIVIDUAL.—The term ‘‘covered
11
individual’’ means an individual committed to the
12
custody of the Bureau of Prisons pursuant to chap-
13
ter 1 of subtitle C of title XI of the National Capital
14
Revitalization and Self-Government Improvement
15
Act of 1997 (sec. 24–101 et seq., D.C. Official
16
Code) who is a resident of the District of Columbia
17
at the time at which the individual was sentenced.
