A BILL
To require the Administrator of the Federal Aviation Admin-
istration to report to Congress on the process by which
air traffic control tower facilities are chosen for replace-
ment, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Air Traffic Control
4
Tower Replacement Process Report Act of 2023’’.

SEC. 2. AIR TRAFFIC CONTROL TOWER REPLACEMENT

PROCESS REPORT.
2
(a) REPORT REQUIRED.—Not later than 120 days
3
after the date of enactment of this Act, the Administrator
4
of the Federal Aviation Administration shall submit to
5
Congress a report on the process by which air traffic con-
6
trol tower facilities are chosen for replacement.
7
(b) CONTENTS.—The report required under sub-
8
section (a) shall contain—
9
(1) the process by which air traffic control
10
tower facilities are chosen for replacement, including
11
which divisions of the Administration control or are
12
involved in the replacement decision-making process;
13
(2) the criteria the Administrator uses to deter-
14
mine which air traffic control tower facilities to re-
15
place, including—
16
(A) the relative importance of each such
17
criteria;
18
(B) why the Administrator uses each such
19
criteria; and
20
(C) the reasons for the relative importance
21
of each such criteria;
22
(3) what types of investigation the Adminis-
23
trator carries out to determine if an air traffic con-
24
trol tower facility should be replaced;

(4) a timeline of the replacement process for an
1
individual air traffic control tower facility replace-
2
ment;
3
(5) the list of facilities established under sub-
4
section (c), including the reason for selecting each
5
such facility; and
6
(6) any other information the Administrator
7
considers relevant.

(c) LIST
OF REPLACED AIR TRAFFIC CONTROL
9
TOWER FACILITIES.—The Administrator shall establish,
10
maintain, and publish on the website of the Federal Avia-
11
tion Administration a list of the following:
12
(1) All air traffic control tower facilities re-
13
placed within the previous 10-year period.
14
(2) Any such facilities in the process of being
15
replaced.
16
(3) Any such facilities under consideration for
17
replacement.
